Kyrgyz Vakf of the 19th Century

Kyrgyz Vakf

The so-called Kyrgyz vakf of the 19th century is not an exceptional phenomenon, although it is quite rare and has barely taken shape. Several types of such vakf are known. All of them are not characteristic of nomadic pastoralism, as they are exclusively related to agriculture. Having acquired such an uncharacteristic form of property for nomads, Alymbek and his heirs did not limit themselves to registering just one land parcel as a vakf. The Fergana regional administration received three more documents regarding the addition of land to the vakf through purchase. One of the documents from 1860 contained a statement from seven residents that they transferred their land rights to Alymbek for 500 gold coins (tilla - ?), after which the land was transferred to the vakf.

This purchase agreement contains an interesting note that after receiving the money from Alymbek, the residents "withdrew their previously filed claim, stating that such a claim from their side should not be heard in the future." Another document from 1863 testified to the sale by 27 residents to Alymbek's eldest son, Jarkinbay, of half of the described land plot for 25 gold coins (tilla - ?). The third document, from 1864, spoke of the sale by nine residents of a plot of land in Chin-Abad, adjacent to Alymbek's vakf, to the vakf manager - the mutawali of the madrasa for 2 gold coins and 2 robes.

All the aforementioned documents only testified to the donation of land to Alymbek's madrasa vakf, either irrigated or purchased by the feudal lord. No special khan's "clearing" certificate was presented to the land tax commission. This, however, does not necessarily mean that it did not exist at all. But even in the absence of such a certificate, the income from the land, most likely, was fully at the disposal of the vakf institution of the madrasa. It was expressed in the usual tax amount - one-fifth of the harvest. It was precisely the deprivation of this share from the madrasa after the land tax survey and the collection of the tax for 1898 into the treasury that prompted complaints and petitions from the mutawali Hasanbek Alymbekov, which led to the creation of the case.
