A couple of weeks ago, while addressing the deputies and newly sworn-in members of the government, the President of Kyrgyzstan, Almazbek Atambayev, emphasized the upcoming presidential elections in 2017. He noted that primarily millionaires have entered the highest legislative body of the country and pointed out that this could happen again during the presidential elections. In his speech, Atambayev stated that if someone who bypassed the Constitution and brought his team to the Jogorku Kenesh (of course without naming names) becomes president, he will pose a threat to the developing business in the country.

DEFICIENCIES OF THE LAW

Atambayev, addressing the parliament, unequivocally hinted that it is time to amend the country's Constitution to reduce the powers of the president and eventually transition to a parliamentary system of governance.
According to the head of state, he does not want to continue turning a blind eye and pretending not to see how the deficiencies in legislation hinder the country's development and pose dangers.
He emphasized that five years ago, the country chose a parliamentary form of governance, but in fact, the transition did not happen. In his opinion, Kyrgyzstan is half in parliamentary governance and half in presidential form.

- Therefore, I agreed to the amendments to the Constitution. But it is necessary for the next parliament to consider this issue without haste, - said Atambayev.
The president believes that the deficiencies in the Constitution are an obstacle to the country's development.
- According to the current Constitution, written by Tekebayev, it turns out that the republic has neither a presidential nor a parliamentary form of governance, stuck between two presses, - agreed with the president's assertion the former deputy of the Jogorku Kenesh, Omurbek ABDYRAKHMANOV. - But the head of state continues to manage the republic - all law enforcement agencies report to him. This situation is much worse than if Kyrgyzstan had exclusively a presidential or exclusively a parliamentary form of governance. Therefore, it is good that Atambayev proposed to switch to a parliamentary system, as in the civilized world, for example, in Germany. All power is concentrated in the hands of the prime minister, and the president has no powers. All countries that have transitioned to a parliamentary system are developed, while those with a presidential form of governance face constant problems. They have civil wars, dictatorship, uprisings, unchanging rulers, like in Uzbekistan or Kazakhstan…

ON THE WAY TO PARLIAMENTARISM

Abdyrahnmanov believes that the parliamentary system is the best in the world. 95% of developed countries live under parliamentary conditions. However, he notes that there is a mandatory condition for the transition - adherence to all international standards. It is necessary to decentralize power and finances, conduct elections for the leadership of the ayil okmotu (local government), and mayors of cities. Under such a form of governance, the prime minister will bear full responsibility for the country.
Many experts agree that Atambayev, at the end of his presidential term, is preparing to head the cabinet of ministers, which will allow him to continue to be at the helm.
- Perhaps he has such thoughts, - continues Abdyrahnmanov. - Let him take the prime minister's chair; no one will particularly oppose it, but on the condition that he takes on the burden of responsibility for all the processes occurring in the country. Right now, the president is not responsible for anything (and is not held accountable anywhere), but shifts all the blame onto the prime ministers; note that we have already changed 25 of them.
Mar BAIDZHIEV, a writer and journalist, agrees that it is necessary to change the Constitution of the country. In his opinion, the existing fundamental law only harms the development of the republic. However, he is convinced that the parliamentary form of governance is to blame for this.

- It is precisely this that has led to the situation where no one in the country is responsible for anything: the parliament should not govern the state but create laws for it. And as a result, parliamentarians do not bear responsibility for their work! It would be much better if both the president and the ministers bore responsibility for political decisions, - emphasized Baidzhiev.

Adakhan MADUMAROV, a politician and public figure, has repeatedly stated that Kyrgyzstan needs a strong presidential rule, as the country does not have time for experiments.
- Our republic has only six million people - that’s a third of Moscow. And the capital of Russia is managed by just one person with his government. Kyrgyzstan is governed by the president, the government, and the parliament. In addition, the country feeds a sea of officials: the president's office, the government office, the parliament office. To calm the Kyrgyz, it is necessary to give him a portfolio. Based on this, the structure of the executive power is formed. Then, from the ambitions of the deputies, parliamentary committees are created, not out of necessity, but out of understanding. Kyrgyzstan needs a strong presidential power, under which the head of state must bear full responsibility for everything. Under a president, a compact cabinet of ministers is necessary, and we do not need a government. For a small state, 120 deputies is too many. I think 45 constantly acting professional people's representatives would be enough for the KR. Moreover, they should not include businessmen, athletes, or market managers, but only professionals in legislative activities.

It should be noted that since 2010, Kyrgyzstan has established a parliamentary-presidential form of governance.
