1. General provisions

1. The Ministry of Culture and Tourism of the Kyrgyz Republic (hereinafter referred to as the Ministry) is the central state executive authority responsible for implementing state policy in the field of culture, arts, and tourism.
2. The Ministry is guided in its activities by the Constitution of the Kyrgyz Republic, the laws of the Kyrgyz Republic, universally recognized principles and norms of international law, international treaties that have entered into force in accordance with the law, to which the Kyrgyz Republic is a party, and other regulatory legal acts of the Kyrgyz Republic, as well as these Regulations.
3. The Ministry is a legal entity, has a seal, stamp, and letterheads featuring the State Emblem of the Kyrgyz Republic, with its name in the state and official languages, an independent balance sheet, and bank accounts in the Treasury system of the Ministry of Finance of the Kyrgyz Republic.
4. The Ministry participates in the management of subordinate organizations and performs the functions and powers of the founder of state institutions of culture and arts in the Kyrgyz Republic.
5. Funding for the maintenance of the central office, subordinate divisions, institutions, and territorial bodies is provided from the republican budget based on the budget estimate, as well as from other sources of funding that do not contradict the legislation of the Kyrgyz Republic.

2. Purpose of the Ministry

6. The purpose of the Ministry's activities is to preserve, promote historical, cultural, and spiritual heritage, and ensure the sustainable development of the culture, arts, and tourism sectors.

3. Tasks of the Ministry

7. The tasks of the Ministry in the field of culture and tourism are:
- ensuring the quality of services provided in the fields of culture, arts, and sectoral education;
- creating conditions for citizens' access to cultural and artistic achievements;
- ensuring the sustainable development of the culture and arts sectors;
- creating conditions for the development of folk creativity and organizing leisure activities for the population;
- creating favorable investment conditions for the development of tourism facilities and infrastructure;
- promoting the growth of quality services provided by the tourism sector;
- forming and supporting a positive image of Kyrgyzstan as a country favorable for tourism.

4. Functions of the Ministry

8. To fulfill the assigned tasks, the Ministry performs the following functions:
1) functions of sectoral policy:
- conducts analysis and assessment of the impact and influence of regulatory legal acts governing the fields of culture, arts, and tourism;
- develops and implements state policy in the fields of culture, arts, and tourism;
- develops drafts of regulatory legal acts on issues within the Ministry's jurisdiction;
- develops proposals for the formation of the republican budget project concerning the financing of the culture, arts, and tourism sectors;
- collects information and prepares informational and analytical materials, expert and forecast assessments within its competence;
- establishes procedures for financing, accounting, identifying, researching, maintaining, conserving, restoring, regenerating, museumifying, and promoting objects of historical and cultural heritage of international and republican significance;
- develops and implements measures to improve the system of sectoral and intersectoral state governance in the fields of culture, arts, and tourism;
2) regulatory functions:
- suspends or prohibits activities that threaten the preservation of monuments of all categories;
- conducts passportization and inventory of cultural and artistic objects and works in state and private ownership;
- conducts expertise of items, collections, and other cultural valuables and issues permits for the export (shipment, temporary export) of cultural valuables in the established manner;
- registers permits for conducting special works on the study of historical and cultural monuments, as well as registers open sheets issued by the Field Committee of the Institute of History of the National Academy of Sciences of the Kyrgyz Republic;
- coordinates maps (schemes) of the location of historical and cultural monuments, historical and architectural master plans of cities and settlements;
- coordinates the protection zones of historical and cultural monuments of republican significance on the territory of the Kyrgyz Republic;
- participates in the coordination of planning, construction, and reconstruction projects of cities and other settlements that have historical and cultural monuments, in the established manner;
- compiles registers of cultural valuables in the fields assigned to the Ministry's tasks;
- creates an artistic-expert council to support and develop state institutions of culture and arts;
- submits proposals for the establishment and awarding of honors for merits and conferring titles in the field of culture and arts;
- studies, summarizes, and analyzes the state of tourism in the republic, determines the main strategic directions for the development of tourism in Kyrgyzstan;
- ensures the implementation and compliance with regulatory and legal acts by legal entities and individuals engaged in tourism activities on the territory of Kyrgyzstan;
- jointly with interested ministries, administrative agencies, and local state administrations develops and conducts state expertise of international, republican, and regional tourism development programs and projects;
- prepares proposals jointly with interested ministries, administrative agencies, and local state administrations for attracting foreign investments in tourism development and submits proposals for creating conditions conducive to the inflow of foreign capital into the tourism sector;
- assists tourism organizations in the republic in promoting their business projects in tourism to attract investments and in developing investment ties with foreign partners;
- prepares and coordinates with relevant ministries and administrative agencies drafts of intergovernmental agreements and international treaties between the Kyrgyz Republic and other states on cooperation in the field of tourism;
- conducts comprehensive analysis and forecasting of the main trends and directions of tourism development;
- promotes the development of competition in the tourism services market and creates equal conditions for all subjects of tourism activity;
3) coordination and control functions:
- coordinates the work on forming the repertoire in state institutions of culture and arts;
- coordinates and controls the activities of subordinate divisions, institutions, and territorial bodies of the Ministry, including educational institutions in the fields of culture and arts;
- coordinates and controls the activities of other state bodies on issues of historical and cultural monument protection;
- keeps records and monitors tourism facilities, conducts state control over their rational use, preservation, and restoration;
- analyzes, monitors, and controls the implementation of state policy in the fields assigned to the Ministry's competence;
- conducts state control over the use and maintenance of historical and cultural monuments, the execution of works on conservation, restoration, repair, museumification, and regeneration of monuments in the established manner;
- conducts internal audits of financial, accounting, administrative, project processes, and management information in the field of culture to improve and develop the internal control system;
- conducts state accounting and control over the condition and storage conditions of the state and non-state parts of the museum fund of the Kyrgyz Republic, as well as library funds related to objects of historical and cultural heritage;
- cancels acts adopted by the culture departments of cities and districts, subordinate divisions, institutions, and territorial bodies that contradict the legislation of the Kyrgyz Republic;
4) support functions:
- interacts with creative unions and other organizations, regardless of ownership forms, on cultural issues;
- places targeted creative orders (including on a competitive basis) for legal entities and individuals for the creation of new works of art (theatrical, musical, choreographic, visual, monumental, decorative-applied, cinematographic, architectural, literary, concert programs, and others) and for providing cultural services;
- organizes work on retraining and improving the qualifications of culture workers;
- assists subordinate divisions, institutions, and territorial bodies in the construction, design, major and current repairs of cultural and artistic facilities;
- develops a sectoral system for encouraging workers in the fields of culture and arts;
- submits proposals to the Government of the Kyrgyz Republic for granting the status of "national" and "academic" to cultural objects in the established manner;
- carries out work on the formation, storage, accounting, and use of archival documents of the Ministry in accordance with the legislation;
- conducts competitions, attestations, and qualification exams for employees of subordinate divisions, institutions, and territorial bodies;
- modernizes and raises the technical and technological levels of cultural, artistic, and tourism institutions;
- prepares materials for presenting employees and workers in the fields of culture, arts, and tourism for state and departmental awards;
- assists in organizing international and republican events, festivals, campaigns, exhibitions, competitions, seminars, and conferences;
- provides the fields of culture and arts with professional personnel.

5. Rights of the Ministry

9. The Ministry has the following rights:
- to submit proposals to the Government of the Kyrgyz Republic on issues of culture, arts, and tourism;
- to submit proposals to the Government of the Kyrgyz Republic regarding the conclusion of international treaties on issues within its competence, in coordination with the Ministry of Foreign Affairs of the Kyrgyz Republic;
- to attract grants from international and other organizations for the Ministry's activities in accordance with the law;
- to request information related to the Ministry's activities from state bodies and local self-government bodies, organizations and enterprises, officials, and citizens of the Kyrgyz Republic in the established manner;
- to create coordinating and advisory bodies (councils, commissions, groups), including interdepartmental ones, in the established area of activity;
- to submit proposals to the Government of the Kyrgyz Republic regarding the creation, reorganization, or liquidation of subordinate divisions, institutions, and territorial bodies;
- to conduct checks on compliance by subordinate divisions, institutions, and territorial bodies with financial discipline, the targeted use of material and monetary resources, approve expense estimates, and control their execution;
- to exercise other powers provided by the legislation of the Kyrgyz Republic in the field of culture, arts, and tourism.

6. Organization of the Ministry's work

10. The Ministry is headed by a minister, appointed and dismissed in accordance with the legislation of the Kyrgyz Republic.
11. The minister is personally responsible for the fulfillment of the tasks assigned to the Ministry and the implementation of state policy in the established area of activity.
12. The minister:
- exercises overall leadership of the Ministry's activities, its board, central office, subordinate divisions, institutions, and territorial bodies, and is responsible for fulfilling the tasks assigned to the Ministry;
- represents the Ministry in relations with the state authorities of the Kyrgyz Republic, local self-government bodies, enterprises, institutions, and organizations of the Kyrgyz Republic and foreign states on the territory of the Kyrgyz Republic, conducts negotiations within his powers on interaction and cooperation on issues within the Ministry's competence;
- issues mandatory orders and directives for execution within the Ministry in accordance with the legislation of the Kyrgyz Republic and these Regulations;
- distributes responsibilities among deputy ministers, heads of structural divisions of the Ministry;
- presents particularly distinguished employees of the Ministry system for state awards, applies other measures of moral and material encouragement, including awarding departmental awards;
- submits proposals to the Prime Minister of the Kyrgyz Republic regarding the appointment and dismissal of heads of subordinate divisions and institutions included in the nomenclature of the Prime Minister of the Kyrgyz Republic;
- appoints and dismisses heads of territorial bodies and subordinate institutions included in the minister's nomenclature in the established manner;
- appoints and dismisses employees of the Ministry's central office, subordinate divisions, territorial bodies, and subordinate institutions, upon the recommendation of the state secretary, in accordance with the law;
- cancels orders of subordinate divisions, institutions, and territorial bodies that contradict the legislation of the Kyrgyz Republic;
- approves the structure and staffing table of the Ministry's central office, subordinate divisions, institutions, and territorial bodies within the established salary fund and maximum number of staff;
- approves regulations on structural divisions of the central office, subordinate institutions, and territorial bodies of the Ministry;
- submits drafts of regulations on subordinate divisions of the Ministry for approval by the Government of the Kyrgyz Republic;
- within his competence, has the right to negotiate and sign international interdepartmental treaties;
- participates in the work of the National Commission of the Kyrgyz Republic for UNESCO on issues assigned to the Ministry's tasks;
- signs collective agreements with the representative body of the Ministry's employees;
- determines and approves the list of positions included in the minister's nomenclature and their functional responsibilities;
- exercises other powers in accordance with the legislation of the Kyrgyz Republic;
- in coordination with the authorized state body in the field of public service, assigns the state secretary the performance of functional duties on sectoral policy issues assigned to the Ministry's competence.
13. The Ministry has established the highest administrative position of state secretary. The procedure for appointment and dismissal, functions, and powers of the state secretary are determined by the legislation of the Kyrgyz Republic.
14. The minister has deputy ministers.
15. Deputy ministers are appointed and dismissed in accordance with the legislation of the Kyrgyz Republic, report directly to the minister, and organize the Ministry's activities within the scope of their assigned responsibilities.
16. The Ministry forms a board consisting of 15 members, including the minister (chairman of the board), state secretary, deputy ministers, heads of subordinate divisions, institutions, a representative of the Government Apparatus of the Kyrgyz Republic, and workers and figures in the fields of culture and tourism.
17. The minister, state secretary, deputy ministers, and heads of subordinate divisions are members of the board by virtue of their positions. The personal composition of the Ministry's board is approved by the Prime Minister of the Kyrgyz Republic upon the minister's recommendation.
18. The activities of the board are determined by the Regulations on the board, approved by the minister's order.
19. A Public Supervisory Council is established under the Ministry, serving as a consultative and supervisory body formed for coordinated interaction between the Ministry and civil society. The decisions of the Public Supervisory Council are advisory in nature.

7. Final provisions

20. The reorganization and liquidation of the Ministry are carried out in accordance with the legislation of the Kyrgyz Republic.
