Activists emphasize that the most important aspects are equality of the parties, adversarial proceedings, access to evidence, collegiality, and balance of interests, which should ensure effective judicial proceedings. The main principles of case preparation include adherence to reasonable timeframes and efficiency, which implies a swift resolution of disputes and the exclusion of unjustified delays.
As noted by "Bir Duyno - Kyrgyzstan," independent journalists, activists, representatives of international organizations, and relatives of Mahabat had been waiting for the hearing to begin in the Supreme Court since 10 a.m. The judges introduced the prosecutor and the lawyers but did not familiarize the board with the case materials, stating that it was multi-volume, and scheduled the next hearing for March 3 at 11:15 a.m.
We believe that the postponement of Mahabat's case by the Supreme Court of the Kyrgyz Republic is arbitrariness on the part of the judges and additional pressure on the victim of torture and ill-treatment, who is in the harsh conditions of an outdated prison system that has not been reformed since Soviet times.Human rights defenders also point to the lack of oversight by the General Prosecutor's Office over the legality in the Supreme Court, as well as the inaction of the Ombudsman institution of the Kyrgyz Republic in response to violations of the rights of torture victims, which contradicts the principles of reasonable timeframes and efficiency.
Recall that Mahabat Tajibek kyzy was detained in January 2024 along with ten colleagues from Temirov Live and accused of inciting mass riots. On February 25, 2025, the judicial board of the Supreme Court of Kyrgyzstan reviewed the appeal of three of the detainees, upholding the decisions of previous instances: Mahabat was sentenced to six years in prison, Azamat Ishenbekov received five years, and Aika Beyshikeeva was found guilty, receiving three years of probation. The Bishkek City Court also sentenced Aktilek Kaparov to three years of probation. The other seven defendants were acquitted due to lack of evidence of a crime.
The next hearing on the defense's motion regarding newly discovered circumstances is scheduled for March 3 at 11:00 in the Supreme Court of the Kyrgyz Republic.
