In Kyrgyzstan, there is a renewed initiative to tighten penalties for the rape and murder of women and children. The corresponding draft law has been put up for public discussion by the presidential administration.
The authors of the initiative emphasize the increase in serious crimes against women and children, which raises serious concerns in society and negatively affects the state of affairs.
"The issue of protecting women and children is particularly urgent today. Official data does not show the full picture. The number of cases of violence against these groups is rising, and many crimes remain unreported.
Cases of violence against children and the murder of women related to rape are becoming commonplace in the news, and society is beginning to stop reacting to this, which is alarming. It is necessary to establish a clear boundary beyond which criminals who commit violence against children and women must be excluded from society and face strict and fair punishment," the authors of the draft law state.
Under the new draft law, it is proposed to introduce life imprisonment with confiscation of property for particularly serious crimes, such as:
- murder related to rape or violent satisfaction of sexual desire (paragraph 8 of part 2 of article 122);
- rape committed against a child under fourteen years old or a person with a disability (part 4 of article 154).
It is also planned to abolish the statute of limitations for murders:
- of two or more persons;
- of a pregnant woman;
- of a person in a helpless state or a child;
- on the grounds of professional activity or public duty;
- out of hooligan motives;
- using methods dangerous to the lives of many people;
- with particular cruelty;
- as a result of kidnapping or hostage-taking;
- associated with robbery, extortion, or terrorist acts;
- against the backdrop of racial, ethnic, national, or religious hatred;
- out of mercenary motives or for reward;
- with the aim of obtaining the organs or tissues of the victim;
- to conceal another crime or facilitate its commission;
- committed by a group of persons;
- by prior agreement;
- by an organized group;
- as part of a criminal community;
- related to rape or violent satisfaction of sexual desire.
It is worth noting that previously in the country, the issue of reinstating the death penalty for serious crimes against women and children was also raised, but the Constitutional Court rejected this initiative.
