New Competition Law. The Antimonopoly Service Will Evaluate Entities Based on "Abuse" Rather Than "Dominance" Criteria

- The discussion of the new KR Law "On Competition" took place on March 13 at the Antimonopoly Regulation Service, which is subordinate to the Ministry of Economy and Commerce. This draft law has already received approval from the Jogorku Kenesh in its first reading.

Pavel Li, head of the department for investigation and control over compliance with antimonopoly legislation and advertising, spoke about the key changes that have been made to the updated version of the law.

The new version of the law includes definitions of terms such as antimonopoly compliance, buyer's compensating power, digital platforms, and network effects.

One of the main changes will be the abandonment of the practice of maintaining a Register of economic entities with a dominant position in the markets, which also implies the exclusion of the "dominant" status for such entities.

The agency explained that this decision is a result of implementing the principle of controlling the economic situation with an emphasis on risks.

"The current version of the law states that entities must be included in the register of 'dominants', which imposed an obligation on them to submit their reports to antimonopoly authorities annually.

With the new draft law, we are moving towards risk-oriented approaches. There will no longer be a standard collection of information. In case of signs of abuse, we will work with a specific entity, rather than based on the fact that it is 'large'," noted Pavel Li.
