The initiator of this document was the Ministry of Economy and Commerce.
The draft implies the introduction of a temporary moratorium on inspections of entrepreneurs, which will be in effect until December 31, 2026. This restriction applies to inspections conducted by law enforcement and other authorized bodies that have the right to control businesses.
However, the draft provides for certain exceptions. The moratorium will not apply to the following types of inspections:
- within the framework of criminal and civil proceedings;
- upon requests from the business entities themselves;
- upon requests from government bodies of other countries;
- upon complaints from individuals and legal entities;
- upon requests from officials of government bodies and local self-government bodies, if there are specific facts of violations with supporting materials, including publications in the media;
- conducted by the customs service within the framework of customs control;
- by tax authorities within the limits established by the president's decree dated January 28, 2026, No. 18;
- by the National Bank in accordance with its powers under banking legislation;
- by the authorized state body in the field of civil aviation.
In addition, the draft proposes to impose personal responsibility for the implementation of this resolution on the heads of law enforcement and other authorized bodies that have the right to conduct business inspections.
The document also provides for the cancellation of the previous Cabinet resolution on this issue, adopted on May 8, 2024, No. 218. At the same time, law enforcement and authorized bodies are recommended to regularly conduct preventive measures and consultations to prevent violations.
Control over the implementation of the resolution will be carried out by the department for monitoring the execution of the decisions of the president and the Cabinet of Ministers of the Presidential Administration. The resolution will enter into force 15 days after its official publication.
