
Currently, the Military Prosecutor's Office of the Kyrgyz Republic is in need of establishing a new operational-investigative body — the Military Investigative Committee (MIC). This prosecutor's office oversees the actions of the Armed Forces, internal troops, national security agencies, and border services. In cases where the detention of suspects or the conduct of operational activities is required, the Military Prosecutor's Office is forced to seek assistance from the Ministry of Internal Affairs and the Ministry of Defense.
For example, detentions in criminal cases initiated by the Military Prosecutor's Office often require the involvement of the Ministry of Internal Affairs special forces or military special units. Additionally, to obtain information about crimes related to cyber technologies, the prosecutor's office has to turn to the State Committee for National Security of the KR, as they have a unit dedicated to cybersecurity.
Thus, it becomes evident that the Military Prosecutor's Office lacks its own law enforcement, operational, and technical resources for conducting investigations and searching for criminals. Turning to other law enforcement structures or national security committees may pose a risk of leaking confidential information and violating investigative secrecy. This is especially relevant when investigating cases against employees of the State Committee for National Security or military personnel with special capabilities.
The establishment of the Military Investigative Committee will significantly enhance the effectiveness of the Military Prosecutor's Office by providing them with an independent mechanism for operational investigations and their own special forces. The structure of the new committee will include the following departments:
Department for the search and detention of suspects. Special technical investigation department (including cybersecurity and modern information gathering technologies). Special operations department (special forces). Surveillance department. Expert-criminalistic department. Human resources department. Office.
The Military Investigative Committee will be headed by a Director and two deputies, who will be provided with state protection. The appointment of the heads of the MIC will be carried out by the President of the KR upon the recommendation of the Attorney General and the Military Prosecutor. Funding for the new committee will be provided from the state budget.
The process of selecting and reviewing candidates for work in the MIC will involve the Military Prosecutor's Office and the Main Intelligence Directorate of the Kyrgyz Republic. Candidates may be active military personnel, graduates of military educational institutions, or officers with experience in operational structures of the Armed Forces and army special units. After its formation and the establishment of all necessary conditions, the Military Investigative Committee will become an effective and combat-ready element within the structure of the Military Prosecutor's Office of the KR.
