Stone and Weapon: Man Sentenced After Conflict with Nephew Over Land Dispute

The Chui Regional Court reviewed the verdict in a case related to a conflict between relatives in the Alamudun District on January 28, 2026.

Essence of the Incident

On April 11, 2025, a quarrel occurred between two relatives in one of the villages of the Alamudun District due to a long-standing dispute over land division. During the conflict, the accused S. B. D. struck the victim M. Zh. several times on the head with a stone. He then exited the house with a TOZ-BM 16 caliber shotgun, loaded it, and attempted to shoot, but his actions were stopped by those nearby.

S. B. D. is a resident of one of the villages in the Alamudun District, a citizen of Kyrgyzstan with a secondary education, married, and previously convicted.

According to the conclusion of the forensic medical examination, the victim sustained minor bodily injuries, including a closed head injury and a concussion.

First Instance Court Decision

On July 31, 2025, the Alamudun District Court found S. B. D. guilty under Articles 37-122 ("Attempted Murder") and 267 ("Illegal Acquisition, Sale, or Possession of Weapons") of the Criminal Code of the Kyrgyz Republic. The court sentenced him to 8 years of imprisonment in a strict regime colony and a fine of 50,000 soms.

Testimony of the Accused

At the first instance court hearing, S. B. D. partially admitted his guilt and recounted the events. He was at home with two colleagues when the son of his older brother, M. Zh., came to their house in a state of intoxication with a gun. When asked about the purpose of his visit, he replied that he had come to shoot pheasants. S. B. D. took the gun from him and placed it under the table. At that moment, M. Zh. began to take the gun back and called his brothers. Soon, brothers S. A. and S. N. arrived with their wives, and a fight broke out. When S. A. attempted to attack S. B. D. with a knife, he retaliated by hitting M. Zh. with a stone, after which his colleagues separated them. After that, the three brothers attacked S. B. D. as he tried to take refuge in the house.

Testimony of the Victim

At the court hearing, the victim M. Zh. stated that on April 11, 2025, after lunch, he went out of the house to look at the gravel. At that moment, S. B. D. called him, and a quarrel began. The accused insulted him, but M. Zh. did not respond. When he turned away, S. B. D. picked up a stone and hit him. After that, the victim fell, and S. B. D. continued to strike him. His daughters-in-law came to help and separated them. As they were leaving, S. B. D. came out with a gun and aimed it at M. Zh., but he managed to press it down. After that, they both went to the police, but they were refused to file a complaint and were told to wait for the investigative group. Eventually, they turned to the GKNB in Bishkek.

Appeal Proceedings

At the appeal stage, S. B. D.'s lawyers insisted on changing the qualification of the crime and terminating the case, as the parties had reached reconciliation and the damage had been compensated.

During the appeal hearing, the victim M. Zh. confirmed that he had reconciled with the accused, had no claims against him, and that both material and moral damages had been fully compensated. He requested that no measures be taken against S. B. D.

Outcome of the Appeal

However, the judicial panel concluded that the accused's actions lacked a "hooligan motive," as the conflict concerned personal relationships and land disputes. Nevertheless, the court indicated that the crime was not completed, and the actions of the defendant should be qualified as attempted murder.

As a result, the verdict was amended: the man was found guilty under Article 37, Part 1, and Article 122, Part 1 of the Criminal Code of the Kyrgyz Republic ("Attempted Murder") and sentenced to 8 years of imprisonment. The remainder of the verdict, including the fine for illegal possession of weapons, remained unchanged. The appeal was not granted.
