According to information from the State Register of Judicial Acts, the incident occurred on March 28, 2025, around 21:30. According to the investigation, Batyр [name changed] returned home in a state of intoxication, which led to a quarrel between him and his wife. The man accused his spouse of cheating on him with his older brother (kaymaga) and began to threaten her with physical harm.
In response to the aggression, Takhmina [name changed T.M.Kh.] took a plastic bottle of gasoline parked near the house, doused her husband with it, and set him on fire using matches. Although the victim survived, the woman's actions were classified as attempted murder.
On July 21, 2025, the Aksy District Court found Takhmina guilty under Articles 37 and 122 Part 1 (Attempted Murder) of the Criminal Code. The court sentenced her to 8 years of imprisonment in a general regime colony. The term of punishment began on April 28, 2025, with one day in the pre-trial detention center counting as two days in the colony.
On September 22, 2025, the Jalal-Abad Regional Court upheld the first-instance verdict, rejecting the defense's arguments.
Takhmina's lawyer filed a cassation appeal to the Supreme Court, requesting the annulment of the verdict or a deferral of the punishment until the youngest child turns 14 years old. The defense presented several arguments:
- prolonged systematic violence and abuse from the husband.
- the victim's state of intoxication during the conflict.
- the presence of three minor children, whom Takhmina raises alone.
On February 11, 2026, the Supreme Court, having reviewed the case materials and heard the parties, partially granted the lawyer's appeal.
The sentences of the Aksy District Court and the Jalal-Abad Regional Court were modified. The Supreme Court, applying Article 75 (Imposition of a More Lenient Punishment) of the Criminal Code, reduced the term of imprisonment to 4 years.
In all other respects, the sentences remained unchanged. This decision is final and not subject to appeal.
