Former chief architect of the Lenin district sentenced to a fine of 1 million soms and banned from working in public service for 1 year — details

The former chief architect of the Lenin district of Bishkek has been sentenced to a fine of 1 million soms for receiving a bribe.

According to materials published in the State Register of Judicial Acts, by the rulings of the courts of first and appellate instances, Nurbek [name changed N.M.A.] was convicted of extorting a large bribe, that is, demanding a bribe from an official personally or through an intermediary for performing or failing to perform actions (inactions) in the interests of the giver that violate his legal rights, as well as placing him in conditions that compel him to give a bribe to prevent harmful consequences to his legally protected interests, under the following circumstances.

The investigation established that Nurbek, as the chief architect of the Lenin district of the Municipal Enterprise "Bishkekglavarchitectura", was obliged to act in accordance with the regulations on the procedure for granting land plots for temporary use for lightweight structures under lease in Bishkek, approved by the resolution of the Bishkek City Council on January 14, 2020, and used the powers specified in the resolution for personal and selfish purposes, and began to extort a bribe.

The investigation found that a pavilion was set up on a municipal land plot where T.K. was engaged in the sale and replacement of motor oil without the necessary permits for the use of the specified land plot. In this regard, in 2023, J.M. offered to assist T.K. in gathering the necessary documents to obtain permission to lease the aforementioned land plot and connected T.K. with the chief architect of the Lenin district, Nurbek, who, through J.M., demanded a bribe of 2000 dollars from T.K. for providing the architectural and technical conclusion necessary for obtaining permission to lease the land plot.

Thus, the investigation believes that J.M. demanded from T.K. the provision of 2000 dollars for a positive architectural and technical conclusion on behalf of Nurbek, and in case of refusal to provide the specified amount, informed him about the impossibility of obtaining a positive conclusion. In this way, Nurbek and J.M., realizing the socially dangerous and criminal nature of their actions, placed T.K. in conditions that compelled him to give a bribe to prevent harmful consequences to his legally protected interests, providing the extorted amount of 2000 dollars to J.M., who would further transfer the funds to Nurbek for obtaining a positive conclusion.

On January 22, 2024, J.M., wishing to complete the implementation of his criminal intent on behalf of Nurbek, met with T.K. near the "My shisha" café around 4:00 PM to receive the extorted sum of 2000 dollars.

During the meeting with T.K. in a "Toyota" car, J.M. received part of the extorted sum of 1000 dollars from T.K.

After that, J.M. headed to Nurbek, where around 6:20 PM in a car near the "Dastan" store at the intersection of Umetalieva and Chokmorova streets in Bishkek, the transfer of the extorted sum of 1000 dollars to Nurbek, previously received from T.K., took place.

By the ruling of the First May District Court of Bishkek on September 30, 2024, Nurbek was found guilty of committing a crime under paragraph 1 of part 2 of article 343 ("Extortion of a bribe") of the Criminal Code, based on which he was sentenced to a fine of 20,000 calculation indicators, that is, 2 million soms to the state, with deprivation of the right to hold positions in state or municipal service for a period of 1 year. The measure of restraint in the form of house arrest was canceled after the verdict entered into legal force.

By the ruling of the judicial panel for criminal cases and cases of offenses of the Bishkek City Court on January 8, 2025, the verdict of the First May District Court was left unchanged.

In a cassation appeal to the Supreme Court, the convicted person requested the annulment of the judicial acts of both instances and his acquittal due to the absence of a crime. He argued that the charges brought against him were not confirmed during the court proceedings; however, despite this, the courts examined the case superficially with a bias towards the prosecution, while the defense arguments remained without proper assessment.

Nurbek also indicated that witnesses in the case confirmed that they did not contact him, that is, they did not meet or talk.

Furthermore, J.M. also confirmed that Nurbek did not extort or demand 2000 dollars from him.

As can be seen from the case materials in the courts of first and appellate instances, the convicted Nurbek did not admit guilt in the charges brought against him and stated that he had known the accused J.M. for about 6-7 years. In October 2023, he approached him for help in obtaining an architectural and technical assignment (hereinafter ATZ) for a facility for replacing motor oil owned by T.K., who is J.M.'s neighbor.

At the same time, J.M. said that they would reward him. T.K. also offered money as a token of gratitude, but he did not demand money from him. The applicant for this ATZ was T.K.'s wife, who came to the one-stop shop; he explained to her that it was necessary to write a repeated application for obtaining the ATZ since the previous term had expired. J.M. called him to find out how things were going with his projects. During their conversation, J.M. mentioned the sum of 1000 dollars as a token of gratitude, but he explained that there were expenses for fines, for preparing materials for the duty plan and archive, for surveying the site, preparing conclusions, etc.

From the testimony of J.A.M., given during the court proceedings, it follows that he is acquainted with Nurbek and T.K. and had a friendly relationship with them. In 2019, he obtained permits for his own projects, as he knew the procedure for obtaining permits, and advised T.K. to obtain permission for his activities.

T.K. approached him for assistance in obtaining these documents. He warned him that such a service with all expenses would cost about 3000 dollars. Since he had acquaintances in the Lenin architecture of the Municipal Enterprise "Bishkekglavarchitectura", he introduced T.K. to Nurbek, telling them to resolve the issues without his involvement. However, T.K. asked him to prepare the documents for 1000 dollars, so he called Nurbek, who agreed to prepare the documents for 2000 dollars.

About a month later, T.K. called him and said that his wife had submitted an application to the Department of Municipal Property Management (DUMI) and that Nurbek would soon prepare the documents for him. A few days after their last conversation, he received a call saying that the documents were ready and that T.K.'s wife should come to the "One-Stop Shop".

On January 22, 2024, T.K. called J.M. and said they needed to meet and asked where he was, to which he replied that he was near the "Kyrgyzstan" shopping center. He got into the car, handed him 1000 dollars, and said that Nurbek asked to give it to him. At that moment, he was detained. When he was detained, his phone was confiscated, and Nurbek called him several times, putting him on speakerphone, and the GKNB officers asked him to contact him. Nurbek said he was at the intersection of Umetalieva and Chokmorova streets and asked him to come; he went there, handed over the money, and was also detained. He never threatened T.K. that if he did not give money, he could be denied the issuance of permits.

From the testimony of the witness T.K., given during the court proceedings, it follows that in Bishkek, on Muromskaya Street, he bought a motor oil replacement point at the end of November 2020, for which he needed permits. In 2021, he met J.M., who offered him his help in obtaining the documents and said that he had acquaintances in architecture. Near his oil replacement point, J.M. had containers. J.M. introduced him to the employee of the Municipal Enterprise "Bishkekglavarchitectura" of the Lenin district, Nurbek.

On December 10, 2023, J.M. called him and said that the documents were almost ready and that this service would cost 3000 dollars. He did not agree to this, as the amount was large, to which J.M. suggested discussing the amount during a meeting.

At the end of December 2023, J.M. called and asked if he had the money ready, as Nurbek was asking him; he replied that the amount was large and he did not have that much money.

J.M. said that if he did not have that much money, he might lose the documents. In January 2024, J.M. said that Nurbek agreed to 2000 dollars, and if he did not give this amount, he would not receive the architectural and technical conclusion. In light of these circumstances, he submitted a statement to the GKNB.

Having reviewed the case materials, the panel of the Supreme Court on August 27, 2025, ruled to change the verdicts of the First May District Court of Bishkek from September 30, 2024, and the judicial panel for criminal cases and cases of offenses of the Bishkek City Court from January 8, 2025, concerning Nurbek.

Nurbek was sentenced under paragraph 5 of part 2 of article 342 ("Receiving a bribe") of the Criminal Code to a fine of 10,000 calculation indicators, that is, 1 million soms to the state, with deprivation of the right to hold positions in state or municipal service for a period of 1 year. The rest of the judicial acts were left in force.

The Supreme Court partially satisfied the cassation appeal of the convicted person. The ruling is final and not subject to appeal.
