The Supreme Court confirmed the decisions of the lower courts regarding the case of a police officer from Kochkor-Ata.

According to the documents available in the State Register of Judicial Acts, the lawyer defending the convicted individual filed a cassation appeal requesting the annulment of the sentences issued by the Jalal-Abad City Court on October 10, 2024, and the Criminal Chamber of the Jalal-Abad Regional Court on March 11, 2025. The defense insisted that the courts examined the case unilaterally, focusing solely on the prosecution's arguments and ignoring the defense's points.

After analyzing the case materials, on August 4, 2025, the Supreme Court upheld the decisions of the Jalal-Abad City Court and the Regional Court.

The cassation appeal was dismissed, and this decision is final and not subject to appeal.

As a result, the police officer was found guilty and sentenced to a fine of 1 million soms, as well as a three-year ban on holding positions in the Ministry of Internal Affairs.

In mid-December 2022, the press service of the State National Security Committee informed about the detention of an employee of the Kochkor-Ata District Department of Internal Affairs named Emir [name changed E.Sh.K.], who was caught on December 15 while attempting to receive a bribe of 50,000 soms.

The investigation established that the police officer threatened a local resident, stating that he would bring him to criminal responsibility if he did not give him a bribe.

A criminal case was initiated against Emir under part 1 of Article 343 ("Extortion of a Bribe") of the Criminal Code. He was detained and placed in the pre-trial detention center of the State National Security Committee.

During the investigation, it was determined that on December 8, 2022, knowing about the drug addiction of the victim A.K., Emir, deceitfully claiming that he intended to "make this public and take action," began to demand money from him. On December 15, he told the victim to leave the money in a store at the intersection of Lenin and Gagarin Streets in Kochkor-Ata. On the same day, when A.K. left 20,000 soms through the store owner Z.M., Emir came for the money and was detained by the operatives of the State National Security Committee. At the time of his arrest, 20,000 soms were found, which he had thrown away.



According to the verdict of the Jalal-Abad City Court dated October 10, 2024, Emir was found guilty under Article 343 part 1 of the Criminal Code and received a fine of 1 million soms with a three-year ban on holding positions in the Ministry of Internal Affairs.

He was also informed that failure to pay the fine would result in criminal liability under part 5 of Article 65 of the Criminal Code. The court resolved the issue regarding the fate of the physical evidence.

Emir filed an appeal against this verdict, noting that at the first instance he did not fully admit his guilt; however, the case was closed as a result of a reconciliation agreement between the parties.

The accused claimed that witnesses and the victim were not summoned to the court hearing, and their testimonies were not heard, therefore the court's decision was made unilaterally. Emir also emphasized that he did not reconcile with the victim and did not receive a statement from him waiving claims, insisting on the need to conduct a "face-to-face confrontation" to confirm his innocence.

He added that he signed the reconciliation agreement without understanding its essence, and that his parents, following the tradition of "kyrgyzchylik," received a statement from the victim waiving claims, of which he was unaware.

He also pointed to the lack of evidence against him and the contradictory testimonies of the victim, claiming that he did not extort money from him. In this regard, he asked the court to annul the decision of the Jalal-Abad City Court dated July 21, 2023, and to issue an acquittal.

The verdict of the Jalal-Abad Regional Court dated March 11, 2025, remained unchanged.
