The court sentenced the former mayor of Osh, who was detained by the State Committee for National Security. He did not admit his guilt.

The Osh City Court issued a ruling in the case of Mirlanbek Toktomushev, who previously held the position of qazi of the city of Osh. The verdict was announced on September 22, 2025.

According to the verdict of the first instance court, Toktomushev was found guilty of abuse of power under Article 245 of the Criminal Code and was fined 120,000 soms.

The press service of the GKNB reported on May 23 that the employees of the qaziat of the city of Osh systematically collected money from the workers of mosques and madrasas illegally.

The State Committee noted that such actions were driven by the personal interests of some representatives of the qaziat and provoked a negative reaction not only towards their work but also towards state authorities in general.

In response, entrepreneurs associated with mosques and madrasas filed a complaint with the GKNB of the Osh region. This case was registered under Article 209 of the Criminal Code concerning fraud.

During searches at the workplace and residence, facts of illegal collections were discovered. As a result, T.M.B. and M.Z.M. were detained and placed in the temporary detention facility of the GKNB.

On May 26, the Spiritual Administration of Muslims of Kyrgyzstan announced that Mirlanbek Toktomushev was relieved of his duties as qazi of the city of Osh.

Samidin Atabaev was appointed to this vacant position.



The investigative authorities accused Toktomushev of initiating a series of crimes against property for his own selfish purposes.

Toktomushev was appointed to the position of qazi by the decree of the mufti of the Spiritual Administration of Muslims of Kyrgyzstan, Zamir Rakiyev, on January 27, 2023. During his tenure, he allegedly acted in his personal interests, seeking illegal enrichment, and from November 2023 to May 2025, he received 15,000 soms monthly from J.S.M., using both cash and electronic transfers for this purpose.

The investigation revealed that J.S. twice handed over cash to Toktomushev through his mother in the amount of 12,000 soms, totaling 24,000 soms for November and December 2023.

Additionally, in January and March 2024, J.S. transferred cash several times in amounts of 15,000 soms and sent a total of 60,000 soms to a phone number associated with the qazi's electronic wallet. Due to the app's malfunction, T.Z. used her daughter's wallet to transfer the funds.

As a result, from November 2023 to May 2025, J.S. transferred a total of 249,000 soms to Toktomushev.

At the court hearing, Toktomushev did not fully admit his guilt but confirmed that he was appointed to the position of qazi by the mufti and that since 2013 he had been involved in the construction of a madrasa at the Sheikhit-Dobo mosque funded by donations.

He indicated that the victims S.Z. and J.T.H. were connected to qazi U.S., who commissioned him to build the madrasa, which was completed in 2015. The first students worked voluntarily and planned to renovate the mosque.

According to Toktomushev, there were shops in the mosque, four of which belonged to U.S., and their demolition was planned.

Previously, the position of qazi was held by Ubaidulla aji Saribaev.

Toktomushev also noted that the initiative to demolish the mosque and build a new 5-story mosque caused a number of problems, especially concerning the plans to relocate women studying at the madrasa owned by his wife.

He denied the accusations of bribery and threats, insisting that he never threatened the victim and had no conversations with her on this matter. Toktomushev asked the court to acquit him.

The investigative authorities qualified Toktomushev's actions as fraud; however, the court found no evidence that he received money from the victim through deception and threats.

Nevertheless, the court established that Toktomushev used his powers for personal interests, which caused harm to the victim. He transferred the building of the madrasa "Sheikhit-Dobo" for operation and received 15,000 soms from her monthly, resulting in damages of 249,000 soms.

According to the act of acceptance-transfer of funds dated June 25, 2025, the material damage was compensated by Toktomushev.

The court concluded that Toktomushev's actions did not contain signs of fraud, but his actions were requalified under Article 245 of the Criminal Code concerning abuse of power.

The Osh City Court found him guilty under this article and imposed a fine of 120,000 soms.

The measure of restraint in the form of house arrest remained in effect until the verdict entered into legal force, after which it would be lifted.

The party dissatisfied with the court's decision has the right to file an appeal within 30 days from the date of the verdict announcement.
