On October 25, 2025, she was charged in absentia, and the judge of the Pervomaisky District Court chose a preventive measure in the form of arrest with placement in institution No. 21 of the State Service for the Execution of Sentences. Ekaterina Bivol has been declared wanted, and investigative actions are ongoing.

The agency emphasized the importance of adhering to the principles of interethnic respect and moral responsibility.
After the investigation began, Ekaterina Bivol stated in an interview for Russian media that "the laws of Kyrgyzstan do not apply to her" and that "no one has contacted her." She added that she resides in Russia and is subject solely to Russian legislation.
