Iskender was convicted of embezzlement or misappropriation of entrusted property in a large amount, as well as abuse of official powers, which led to significant damage.
According to the investigation, while serving as the general director of [the enterprise], he, abusing his position, appropriated a room in a dormitory without the consent of the owners of the shared property and later sold it for 414,180 soms.
The case materials also state that Iskender, without notifying the residents and owners, obtained a technical passport for a non-residential premises of 128.4 square meters, which was previously used as showers and sanitary facilities. He subsequently re-registered this premises in his name and in the names of other people, thereby violating the rights of the owners and residents.
- By the decision of the Lenin District Court, Iskender was found not guilty under paragraph 3 of part 4 of article 245 "Abuse of power by employees of commercial or other organizations" of the Criminal Code of the Kyrgyz Republic due to the absence of a crime.
- He was found guilty under paragraphs 1 and 2 of part 4 of article 210 "Embezzlement or misappropriation of entrusted property" of the Criminal Code of the Kyrgyz Republic and was released from criminal liability due to the expiration of the statute of limitations.
- The judicial panel for criminal cases and offenses of the Bishkek City Court overturned the decision of the Lenin District Court regarding the acquittal. Iskender was found guilty of abusing official powers, but no punishment was imposed due to the expiration of the statute of limitations.
The victims in their cassation appeal also requested to change the verdict and impose a penalty on Iskender under paragraphs 1 and 2 of part 4 of article 210 of the Criminal Code of the Kyrgyz Republic.
