The penalties for minor fraud include:
- a fine ranging from 50,000 to 100,000 soms,
- corrective labor for up to one year,
- or imprisonment for up to one year.
If fraud is committed:
- in a significant amount;
- by a group of individuals or by prior agreement;
- using internet technologies,
the punishment increases to imprisonment for a term of two to four years with confiscation of property.
In cases of large-scale fraud or if two or more people were harmed, imprisonment for a term of five to seven years with confiscation of property is provided.
In the presence of:
- particularly large damage;
- organization of a criminal scheme as part of a group;
- use of official position,
the term of imprisonment will be from 8 to 12 years with confiscation of property and a prohibition on holding certain positions for up to three years.
The law also includes an important provision: if a person fully compensates for the damage caused by intentional non-fulfillment of obligations, and their actions do not contain other criminal signs, they may avoid criminal liability.
