Failure to pay alimony for more than 12 months may result in imprisonment

The Deputy Head of the Bailiff Service under the Prosecutor General's Office, Kubanychbek Kapalov, stated on the air of "Birinchi Radio" that for non-payment of alimony, an arrest of up to 7 days may be imposed. If the debt exceeds 12 months, this becomes grounds for initiating a case against the debtor.

Kapalov also noted that on June 23, 2025, a presidential decree was issued aimed at increasing responsibility for evading alimony payments. This document contains amendments to Article 443 of the Code of Offenses, which introduce an arrest of 3 to 7 days, as well as amendments to Article 178 of the Criminal Code of Kyrgyzstan, introducing the possibility of imprisonment.

Furthermore, the deputy head emphasized that probation measures for debtors have been excluded.
According to Article 178 of the Criminal Code of the Kyrgyz Republic, adopted in 2021, if parents evade compliance with a court decision on alimony payments for the maintenance of a child or incapacitated adults in need of financial support, and the amount of debt exceeds 12 months, this is punishable by corrective labor for a period of one to three years, a fine of 500 to 1000 calculated indicators, or imprisonment for up to three years.
