In the reconstruction of the stadium for 26 million soms, a neighbor was invited to participate — the court issued a verdict against the contractor from Talas, who was detained by the GKNB.

The man who was subjected to criminal prosecution was fined 1 million soms and deprived of the right to participate in tenders for a period of two years.

According to information provided by the GKNB in mid-May 2024, cases of abuse of office by some employees of the Talas city administration and the municipal enterprise "Talas Green Economy" were identified. It was also noted that the contracting organization responsible for the major renovation of the E. Kutmanalieva Stadium failed to fulfill the contract conditions.

According to materials from the GKNB, employees of "Talas Green Economy" entered into a direct contract with the contracting organization for an amount of 25 million soms without conducting a tender.

Regardless of the existing violations of deadlines and quality of work, funds were allocated to the contractor for the major renovation.
As reported by the GKNB press service on June 19, some employees of the "Green Economy" signed contracts with the contractor for an amount of 25 million soms, despite the absence of a license for construction work and the necessary experience.

An audit conducted due to discrepancies in the volumes of work, salary indices, taxes, and material costs showed that the damage to state interests amounted to more than 4 million soms.

As a result, the director of the municipal enterprise "Talas Green Economy" A.M. [Ailchiev Mars Jumashbekovich] and a representative of the contracting firm T.S. were detained.
Judicial materials indicate that Samat [name changed T.S.T.] acted on behalf of the LLC "M.S." without having documents confirming his affiliation with this organization. Together with officials from the Talas city administration, he worked on the reconstruction of the football field, harming state interests for selfish reasons.

The investigation established that on September 7, 2023, the municipal enterprise "Talas Green Economy" held a tender for the major renovation of the stadium, which failed due to a lack of participants. Knowing about the tender's failure, Samat, with the help of connections with partner M.A., convinced the director of the municipal enterprise A.M. to conclude a contract with LLC "M.S.", resulting in a contract being signed for the amount of 25 million 998 thousand 900 soms.

Despite being aware of the requirements for contracting organizations, Samat incited the conclusion of the contract, even without having a license for construction work.

From the moment the contract was signed, Samat, responsible for the major renovation, was obliged to monitor the targeted use of budget funds and the quality of work performed. However, he colluded with the director of M.P. M.A., allowing him to carry out contracting work by providing fictitious acts of completed work with inflated volumes.

The audit revealed a discrepancy of 2 million 779 thousand 810 soms, of which 400 thousand 141 soms were discrepancies in physical volumes, while the remainder was taxes.

According to the head of the private bureau K.T., the costs for purchasing seats for the stadium, including delivery from China, could amount to 2 million 400 thousand soms, while the act of completed work stated the cost of one seat as 1 thousand 600 soms, leading to an overall difference of 1 million 440 thousand soms.

Investigative authorities established that the total amount of discrepancies amounted to 4 million 219 thousand 810 soms. Acting in bad faith, Samat caused significant material damage to the state, creating unfavorable conditions for the quality of the renovation.

According to the case materials, Samat grossly violated obligations for the major renovation, which negatively affected the reputation of the stadium. LLC "M.S.", not being a VAT payer, inflated the cost of work, resulting in a difference of 2 million 779 thousand 810 soms.

On October 1, 2024, the Talas City Court issued a verdict in which Samat was acquitted under part 3 of Article 41 and part 3 of Article 337 of the Criminal Code but was found guilty of poor-quality construction under part 2 of Article 273. He was fined 1,500 calculation indicators, amounting to 150 thousand soms, and deprived of the right to participate in tenders for 2 years.

The measure of restraint in the form of detention was lifted, and until the verdict came into force, a subscription to not leave was applied, releasing him in the courtroom.

After the verdict came into force, the subscription to not leave was canceled.

On February 3, 2025, the judicial panel for criminal cases and offenses of the Talas Regional Court changed the verdict of the Talas City Court from October 1, 2024.

The acquittal part under Articles 41 and 337 of the Criminal Code was canceled, and Samat was found guilty, receiving a fine of 10 thousand calculation indicators, amounting to 1 million soms, along with deprivation of the right to participate in tenders for 2 years.

In accordance with Article 77 of the Criminal Code, by partial addition, his final punishment was set at a fine of 11 thousand calculation indicators, amounting to 1 million 100 thousand soms, with deprivation of the right to participate in tenders for 2 years.

The rest of the verdict remained unchanged. The appeal was granted, while the lawyer's complaint was left ungranted.

In the cassation appeal, Samat's lawyer requested the cancellation of the guilty verdict under part 2 of Article 273 of the Criminal Code and his acquittal.

The rest of the verdict of the Talas City Court from October 1, 2024, remained unchanged.

During the court proceedings, Samat stated that in September 2023, a contract for the major renovation of the stadium was concluded between the LLC and the Talas city administration. He was acquainted with the director of M.P. M.D.A. due to previous joint projects, after which they discussed the possibility of participating in the reconstruction of the stadium.

After meeting with the mayor of Talas city E.D.P. and his team, they discussed the project and prepared a local estimate for 28 million soms; however, the mayor stated that they did not have such an amount in the budget. As a result of the bidding, the amount was reduced to 26 million soms.

After reviewing the project, they were asked to submit a local estimate, which was prepared for 28 million soms. Then, after discussions, they agreed on the amount of 26 million soms.

Samat, interested in the project, suggested to his neighbor B.J. to participate together in the stadium reconstruction project, which she agreed to. Finally, they provided the signed contract to the mayor of the city.

According to Samat, after the contract was signed, they signed a subcontract with the company "S.S." for laying the covering. All tranches were transferred, and upon completion of the work, the city administration planned to conduct acceptance.

The repair work was completed at the end of November 2023, and the city administration agreed to accept it in the spring. However, upon arrival on March 20, Samat noticed problems with the covering, which led to additional costs.

The Supreme Court reviewed the case materials and changed the verdict of the Talas Regional Court from February 3, 2025.

Based on part 7 of Article 80 of the Criminal Code, the final punishment in the form of a fine was reduced to 10 thousand calculation indicators, or 1 million soms. The rest of the verdict remained in force, and the cassation appeal was left ungranted. The ruling is final and not subject to appeal.
