In Naryn, a woman forbade her husband from changing the cow, and he dealt her a fatal blow to the thigh and went to sleep.

The Supreme Court confirmed the decisions of the lower courts in the case of the murder of a woman that occurred in the Naryn region.

According to the materials posted in the State Register of Judicial Acts, the investigation established that the accused pensioner Batyr (name changed Ö.B.A.), living in one of the villages of the Naryn district, was drinking alcohol with his wife Azharkul (name changed A.D.) at their home in the evening. After some time, a conflict arose between them, during which Batyr suggested to his wife: “Let’s exchange the cow in the yard for a cow with a calf.”

To this, Azharkul replied: “You always do this. There will be no exchange, don’t touch the livestock,” which led to further quarrels. In a fit of rage, Batyr grabbed a knife that was on the table and struck his wife in the left thigh. As a result, the woman died on the spot due to a severe injury that caused damage to the femoral artery.

A criminal case regarding the incident was initiated on November 7, 2024, under part 1 of Article 122 of the Criminal Code (“Murder”).

According to the verdict of the Naryn District Court dated January 31, 2025, Batyr was found guilty and sentenced to 8 years in prison.

Disagreeing with the decision of the first-instance court, Batyr filed an appeal, requesting to overturn the verdict and reclassify his actions under Article 127 of the Criminal Code (“Causing death by negligence”). He claimed that they had guests that evening and were drinking together. After their departure, a quarrel began, during which, being in a state of intoxication and anger, he struck his wife with a knife. Batyr also added that after that he went to another room and went to sleep, and in the morning saw her lying on the ground, which frightened him greatly. He called a paramedic and neighbors, claiming that he did not realize he had committed murder since his wife had not called for help.

The prosecutor, in turn, responded to the appeal, insisting that the verdict of the first-instance court should remain unchanged.

The defendant's lawyer supported his appeal, arguing that Batyr's actions were not intentional and that the tragedy occurred by negligence, suggesting reclassifying the charge under Article 127 of the Criminal Code.

The sister of the deceased Azharkul stated in court that she had not observed serious conflicts between the spouses and had never heard Batyr raise a hand against her sister; they lived peacefully. She added that she forgives her brother-in-law and, considering his deteriorating health and hearing problems, asks for a lighter sentence.

The Naryn Regional Court, having reviewed the case on August 7, 2025, upheld the verdict of the Naryn District Court dated January 31, 2025, rejecting the defendant's appeal.

On October 28, 2025, the Supreme Court also confirmed the decisions of the previous instances.
