The Ministry of Justice proposes to legalize digital evidence in criminal proceedings

In the Kyrgyz Republic, a draft law has been developed with the aim of introducing the institution of digital evidence. This step is aimed at updating criminal and procedural legislation in light of the realities of the digital age.

According to the Ministry of Justice, the project involves amendments to the Criminal Code, the Criminal Procedure Code, and the Code of Offenses, which will officially define the concept of digital evidence. It will also establish rules for their collection, documentation, storage, and use in judicial proceedings.

Particular attention in the project is given to the protection of citizens' rights. Procedural guarantees related to the handling of digital data connected with the confidentiality of correspondence, personal information, and private life are introduced, as well as mechanisms for judicial oversight.

Furthermore, the draft law proposes updating outdated terminology to align it with the Digital Code of the Kyrgyz Republic. Legal mechanisms for working with virtual assets, which are becoming increasingly common objects of crime, are also introduced.

The adoption of this draft law will create a modern legal framework for combating cybercrime, establish clear rules for handling digital data, and ensure uniformity in law enforcement. This, in turn, will enhance the protection of citizens' rights and the effectiveness of investigations into crimes committed using the internet, digital services, and telecommunications networks.
