The State Enforcement Service under the General Prosecutor's Office of the Kyrgyz Republic clarifies issues regarding temporary restrictions on citizens' exit from the country.

According to the legislation of Kyrgyzstan, temporary exit restrictions can be imposed for various reasons, each having its own specifics regarding both the imposition and the procedure for lifting the restrictions.

Restrictions imposed by enforcement officers

Enforcement officers can impose temporary exit restrictions on citizens for the following reasons:

1.1. For offenses, including fines imposed by authorized state bodies, as well as for violations of traffic rules.

If the decision to collect the fine has become final and has not been executed within the established time frame, the enforcement officer has the right to impose a temporary exit restriction on the debtor.

To lift this restriction, the debtor must fully pay off their debt. Payment can be made through mobile applications, and the information is updated automatically within 24 hours after the payment is made, allowing for the restriction to be lifted.

1.2. For court decisions related to unfulfilled obligations, such as debts, alimony, taxes, and loans.

If the court decision has come into force and has not been executed, the enforcement officer may impose a temporary exit restriction within the framework of enforcement proceedings.

Lifting restrictions in such cases is possible under the following conditions:

complete fulfillment of the requirements of the enforcement document;
submission of a written application by the creditor;
full payment of alimony obligations;
full execution of obligations for periodic payments;
completion of enforcement proceedings in accordance with the law.

The decision to lift the restriction is made by the enforcement officer, guided by current legislation.

Restrictions imposed by law enforcement and state bodies

It should be noted that the State Enforcement Service is not responsible for all types of temporary exit restrictions from Kyrgyzstan, as some may be imposed by law enforcement and state bodies.

During criminal proceedings, as well as by court decision in the course of judicial proceedings, a temporary exit restriction may be imposed to ensure compliance with the claim.

For such restrictions, the State Enforcement Service has no authority. The issue of lifting restrictions is resolved only by the body or court that imposed them.

The State Enforcement Service recommends that citizens check for debts in advance before planned trips abroad. Timely fulfillment of obligations will help avoid restrictions and ensure free movement.
