The National Bank of Kyrgyzstan proposes to increase the requirements for the minimum size of charter and own capital for banks

The National Bank of Kyrgyzstan proposes to the public to discuss the increase in requirements for the minimum sizes of charter and own (regulatory) capital for new and existing banks:

Minimum sizes of charter and own (regulatory) capital of commercial banks

Based on Articles 5, 9, and 64 of the Constitutional Law of the Kyrgyz Republic "On the National Bank of the Kyrgyz Republic" and Article 21 of the Law of the Kyrgyz Republic "On Banks and Banking Activities," the Board of the National Bank of the Kyrgyz Republic makes the following decisions:
1. Establish a minimum charter capital for new commercial banks (including branches of foreign banks) at no less than 5.0 billion soms.

2. For existing commercial banks, establish the following minimum sizes of charter capital:

— from July 1, 2026 – 1.0 billion soms;

— from July 1, 2027 – 2.0 billion soms;

— from July 1, 2028 – 3.0 billion soms;

— from July 1, 2029 – 4.0 billion soms;

— from July 1, 2030 – 5.0 billion soms.

3. For systemically important commercial banks, the minimum size of charter capital is set at no less than 8.0 billion soms from July 1, 2026.

4. Banks recognized as systemically important must increase their charter capital to the established amount within one year after notification from the National Bank of the Kyrgyz Republic.

5. The new minimum size of own (regulatory) capital for newly established banks must correspond to the minimum size of charter capital specified in paragraph 1, and for existing banks – to paragraphs 2 and 3 of this resolution.

At the same time, from the moment of notification of systemic importance, the own (regulatory) capital must be brought to the minimum level established in paragraph 3 within three months.

6. Individuals who have received permission to establish a bank at the time of the adoption of this resolution must bring the size of the charter capital to the required level before obtaining a banking operations license.

7. Individuals applying for the establishment of a bank after the adoption of this document are required to form the charter capital in accordance with paragraph 1.

8. When acquiring 100% of the voting shares of an existing bank, the new entity must increase the charter capital to the minimum level established in paragraphs 1 or 4 within one year.

9. The resolution of the Board of the National Bank of the Kyrgyz Republic "On the Minimum Size of Charter and Own (Regulatory) Capital of Commercial Banks" dated March 15, 2023 No. 2023-P-17/16-4-(NPA) is recognized as invalid.

10. To the Legal Department:

— within three working days from the moment of receiving the necessary documents, publish this resolution on the official website of the National Bank of the Kyrgyz Republic;

— after publication, send the resolution to the Ministry of Justice of the Kyrgyz Republic for registration in the State Register of Regulatory Legal Acts.

11. The resolution comes into force on January 1, 2026.

12. The Licensing Department must inform the Association of Legal Entities "Union of Banks of Kyrgyzstan" and all commercial banks about this resolution within three days.

13. The "Board Secretariat" Department must notify structural divisions, regional departments, and the Representative Office of the National Bank of the Kyrgyz Republic in the Batken region about the resolution within three days.

14. Control over the implementation of this resolution is assigned to a member of the Board of the National Bank of the Kyrgyz Republic responsible for licensing management.
