The Ministry of Internal Affairs proposes to reinstate the institution of recidivism. The Housing Committee reviewed the bill in its first reading.

The Committee of the Jogorku Kenesh, which deals with issues of the judicial system, law enforcement, and the fight against crime, gave a positive assessment of the bill at the first stage of consideration. This document proposes amendments to several codes: the Penal Enforcement Code, the Criminal Code, and the Criminal Procedure Code.

Deputy Minister of Internal Affairs Erkebek Ashirkhodzhaev noted that after the abolition of the recidivism institution in 2019, there has been an increase in the influence of organized crime groups. This is due to the lack of strict accountability for those who commit repeat offenses.

Currently, repeat offenders are subjected to measures such as probation or parole, and receive the same penalties as individuals who are being prosecuted for the first time.

The bill proposes to strengthen the responsibility for repeat offenders. Thus, the punishment for recidivism should not be less than half of the maximum term, for dangerous recidivism — not less than two-thirds, and for especially dangerous recidivism — not less than three-quarters of the maximum punishment provided for this crime.

Furthermore, if a crime was committed as part of an organized group or criminal community, exemption from criminal liability through an agreement with the victim will not be available for individuals who are classified as dangerous or especially dangerous repeat offenders. Recidivism will be considered an aggravating circumstance, and such individuals will not be subject to probationary control or parole.

Additionally, for many crimes related to organized crime, such as murder, violence, robbery, extortion, theft, rape, pornography, kidnapping, and others, a new qualifying feature is introduced — the commission of these acts with dangerous or especially dangerous recidivism. This will lead to stricter liability and classification of actions as more serious crimes.
