The Prosecutor General's Office opposed the Interior Ministry's bill proposing to reinstate the concept of recidivism.

The Deputy Attorney General Umutkan Konkubaeva commented on the decision to abolish the recidivism institution in Kyrgyzstan. She noted that during the first reading, a draft law aimed at restoring this institution was approved.

According to Konkubaeva, the overall crime rate in the country has decreased; however, there has been an increase in cases of theft and fraud. "The reasons for abolishing recidivism were related to the imbalance in punishments," she explained. "For example, a person who stole a chicken could receive 5 years, while corrupt officials would get off with a fine of 5,000 soms. The introduction of recidivism will allow for stricter penalties: for repeated theft, one could face up to 7 years in prison. The victim has the opportunity to file a counterclaim for damages, but even in this case, strict measures will be applied," she added.

Konkubaeva also emphasized the importance of retaining the concept of "recidivism," but suggested reviewing the terms of punishment and eliminating contradictions in the legislation. She pointed out that some norms contradict the Constitution, which prohibits double liability for the same crime. If Parliament adopts this draft law, experts may submit their comments.

Deputy Minister of Internal Affairs Erkebek Ashirkhodzhaev noted that the draft law does not violate the Constitution and only proposes stricter penalties. He added that the term of imprisonment can be reviewed and adjusted if necessary.
