The Cabinet of Ministers has changed the procedure for administering the collection for the retention of licenses for subsoil users.

The Cabinet of Ministers of the Kyrgyz Republic has updated a number of its decisions regarding the collection of non-tax revenues from subsoil users. The resolution, signed on March 9, 2026, aims to implement subparagraph 5 of paragraph 3 of Article 16 of the Code on Non-Tax Revenues.

The changes made affect provisions related to the Ministry of Natural Resources, Ecology and Technical Supervision, as well as the Kyrgyz Geological Service.

According to the new amendments, the functions of these state bodies no longer include fees for the retention of licenses for subsoil use. At the same time, they are granted powers to approve the calculations of fees submitted by subsoil users.

Additionally, the Ministry of Natural Resources and the Kyrgyz Geological Service will now exercise control over the accuracy of calculations, reports, and recalculations of this fee.

The resolution was published in the newspaper "Erkin Too" on March 17, 2026, and comes into effect 15 days after its official publication.

Chapter 1. General Provisions

1. The Ministry of Natural Resources, Ecology and Technical Supervision of the Kyrgyz Republic (hereinafter - the Ministry) is the authorized executive body responsible for the development and implementation of state policy in the field of environmental protection, ecology, climate, geology, and subsoil use, as well as for monitoring compliance with environmental and industrial safety requirements.

2. In its activities, the Ministry is guided by the Constitution of the Kyrgyz Republic, laws, decrees of the President, resolutions, and other regulatory acts, as well as international treaties that have entered into force in accordance with the legislation of the Kyrgyz Republic.

3. The Ministry is a legal entity, has a seal with the image of the state emblem and its name in the state languages, as well as other seals and accounts in the Treasury system of the Ministry of Finance.

The Ministry is the legal successor of the State Committee for Ecology and Climate of the Kyrgyz Republic.

4. The Ministry has subordinate divisions, regional bodies, and state enterprises with the right to act as founders of new legal entities.

5. The full name of the Ministry:

- in the state language: "Кыргыз Республикасынын Жаратылыш ресурстары, экология жана техникалык козомол министрлиги";

- in the official language: "Ministry of Natural Resources, Ecology and Technical Supervision of the Kyrgyz Republic".

The abbreviated official name:

- in the state language: "ЖРЭТКМ";

- in the official language: "МПРЭТН".

6. Legal address: 720040, Kyrgyz Republic, Bishkek, Erkindik Boulevard, 2.

7. The Ministry carries out its activities in cooperation with state bodies, local authorities, scientific institutions, and public associations.

8. The Ministry enters into civil law relations in its own name, has the right to represent the interests of the Kyrgyz Republic within the framework of the legislation.

Chapter 2. Purpose of the Ministry

9. The main purpose of the Ministry is to preserve the unique ecological system of the Kyrgyz Republic and create a favorable environment for the life of citizens, protect natural resources, and effectively monitor compliance with environmental safety standards.

Chapter 3. Tasks of the Ministry

10. The tasks of the Ministry include:

- development and implementation of a unified state policy in the field of environmental protection and natural resources;

- introduction of modern technologies in topographic, geodetic, and cartographic works;

- increasing the effectiveness of state control over compliance with environmental standards;

- protection of biological diversity and rational use of natural resources;

- ensuring sustainable development of specially protected natural areas;

- monitoring compliance with environmental safety requirements.

Chapter 4. Functions of the Ministry

11. The Ministry performs the following functions:

1) implementation of sectoral policy:

- development and implementation of state policy in the field of environmental protection;

- organization of inventory of pollutant emissions;

- participation in the formation of the ecological network and development of new models of natural resource use;

- forecasting mineral resource reserves;

- implementation of scientific research projects.

2) regulatory functions:

- state regulation in the field of environmental protection;

- issuance of licenses for licensed activities;

- monitoring compliance with the conditions of licenses and permits.

3) coordination functions:

- coordination of the work of state bodies and local authorities in the field of environmental protection;

- monitoring the use of natural resources and geological study of the territory.

4) control functions:

- monitoring compliance with environmental and industrial safety;

- verification of the accuracy of calculations of fees for natural resource use.

5) service provision functions:

- conducting laboratory research;

6) support functions:

- dissemination of environmental information and preparation of state reports on the state of the environment.

Chapter 5. Rights of the Ministry

12. The Ministry has the right to:

- submit proposals to the Cabinet of Ministers on issues within its competence;

- create coordinating bodies and participate in international projects;

- obtain information from enterprises and organizations to fulfill its functions;

- conduct inspections and issue orders to ensure compliance with legislation.

Chapter 6. Organization of the Ministry's Activities

13. The Ministry is headed by a minister appointed by the President of the Kyrgyz Republic.

14. The Ministry has positions for the first deputy and deputy ministers.

15. Deputy ministers are appointed by the Chairman of the Cabinet of Ministers upon the recommendation of the minister.

16. Decisions of the Ministry are made in the form of orders and directives signed by the minister.

Chapter 7. Final Provisions

20. The financing of the Ministry is carried out from the republican budget and other permitted sources.

21. The liquidation and reorganization of the Ministry are carried out in accordance with the legislation of the Kyrgyz Republic.

22. In the event of the cessation of activities, the documents of the Ministry will be stored in accordance with the Law "On the National Archival Fund of the Kyrgyz Republic."
