According to the new decree:
- The head of the National Investment Agency will now participate in Cabinet meetings when issues of investment policy, projects, and agreements are on the agenda;
- The position of the head of the agency will be listed in the register of state and municipal positions in paragraph 7 of the first section after the positions of "Deputy Chairman of the Cabinet of Ministers, Deputy Head of the Administration of the President, Member of the Cabinet of Ministers (Minister, Chairman of the State Committee)";

It is important to note that the Register of State and Municipal Positions of the Kyrgyz Republic consists of several sections, and the first section is called "Political State Positions". In this section, the position of the President of the country comes first, followed by the Chairman of the Jogorku Kenesh, then the Chairman of the Cabinet, and other positions.

“[the agency – ed.] will carry out centralized coordination of the process of developing, agreeing upon, and concluding investment agreements, public-private partnership projects, and other investment projects, as well as monitoring their implementation;”

The full list of changes
The decree "On the Enhancement of the Status and Strengthening the Role of the National Investment Agency under the President of the Kyrgyz Republic" has been adopted to improve the efficiency of state management in attracting investments.
In accordance with Articles 66 and 71 of the Constitution of the Kyrgyz Republic, it is decreed:
1. The head of the National Investment Agency will participate in Cabinet meetings on issues related to investment policy and projects.
2. Amend the Decree of the President of the Kyrgyz Republic "On Approving the Register of State and Municipal Positions of the Kyrgyz Republic" dated January 31, 2017, No. 17:
in the first chapter:
– the seventh paragraph is to be reworded as follows:
“Deputy Chairman of the Cabinet of Ministers, Deputy Head of the Administration of the President, Member of the Cabinet of Ministers (Minister, Chairman of the State Committee), Head of the National Investment Agency under the President of the Kyrgyz Republic”;
– the sixteenth paragraph is also to be reworded: “Head of a state body under the President (under the direct jurisdiction of the President) – excluding the head of the National Investment Agency, head of the administrative agency under the Cabinet of Ministers, and head of another executive authority.”
3. Changes to the Decree of the President of the Kyrgyz Republic "On Issues of the National Investment Agency under the President of the Kyrgyz Republic" dated April 15, 2022, No. 115:
in the Regulation on the National Agency the following change:
– the second paragraph of subparagraph "b" of paragraph 13 is to be stated as follows:
“coordinates the process of developing, agreeing upon, and signing investment agreements, public-private partnership projects, and other investment projects and programs, as well as monitors their implementation;”;
– paragraphs 17 and 18 are to be stated as follows:
“17. The activities of the National Investment Agency are managed by the head, who is appointed and dismissed by the President of the Kyrgyz Republic in accordance with the legislation.
18. The agency will have deputy heads, appointed at the proposal of the head of the agency by the Chairman of the Cabinet of Ministers. These deputies must be fluent in English or another foreign language.
The deputies of the head of the agency report directly to the head and perform their duties within their authority.”;
– paragraphs 20 and 21 are to be stated as follows:
“20. In the absence of the head of the agency, one of his deputies will perform his duties.
21. All agency employees, except for the head and his deputies, as well as employees of the state institution "Center for Public-Private Partnership" and free economic zones, are state civil servants. The positions of the head and his deputies are classified as political state positions.”;
– in paragraph 22:
in the first paragraph, replace “Director” with “Head of the National Agency”;
in the eighth paragraph, replace “deputies of the director” with “deputies of the head of the agency.”
4. The Cabinet of Ministers of the Kyrgyz Republic must within two months:
1) bring its decisions in line with this Decree;
2) take other measures arising from the specified changes.
