The President of Kyrgyzstan, Sadyr Japarov, has signed a decree that updates the status and role of the National Investment Agency under the President of the Kyrgyz Republic.
This step is aimed at increasing the efficiency of state governance in the area of attracting investments. According to Articles 66 and 71 of the Constitution of the Kyrgyz Republic, the following measures are announced:
The head of the National Investment Agency will participate in Cabinet meetings on issues related to investment policy, projects, and agreements. Amendments are made to the President's decree "On the Approval of the Register of State and Municipal Positions of the Kyrgyz Republic" dated January 31, 2017, No. 17: In the first chapter of Section I:
– the seventh paragraph will be stated in a new version:
“Deputy Chairman of the Cabinet of Ministers, Deputy
Head of the President's Administration, member of the Cabinet of Ministers
(minister, chairman of the state committee), head
of the National Investment Agency under the President of the Kyrgyz
Republic”;
– the sixteenth paragraph will be changed to: “Head of the state body under the President (directly subordinate to the President) – except for the head of the National Investment Agency under the President of the Kyrgyz Republic, head of the administrative agency under the Cabinet of Ministers, head of another executive authority.”
Amendments will be made to the decree “On Issues of the National Investment Agency under the President of the Kyrgyz Republic” dated April 15, 2022, No. 115: In the Regulation on the National Investment Agency:
– the second paragraph of subparagraph “b” of paragraph 13 will be stated as follows:
“carries out centralized coordination of the development, approval, and conclusion of investment agreements, public-private partnership projects, and other investment projects and programs of state bodies and local self-government bodies, as well as monitoring their implementation;”;
– paragraphs 17 and 18 will be changed to:
“17. The head of the National Agency is appointed and dismissed by the President of the Kyrgyz Republic in accordance with the legislation.
Positions of deputies of the head will be created in the agency, who are appointed and dismissed by the Chairman of the Cabinet of Ministers upon the recommendation of the head of the agency. Deputies must be fluent in English or another foreign language. The deputies report to the head of the agency and perform duties within their authority.”;
– paragraphs 20 and 21 will be changed to:
“20. In the absence of the head of the agency, his functions are performed by one of the deputies.
21. All employees of the agency, except for the head and deputies, as well as employees of the Center for Public-Private Partnerships and free economic zones, are civil servants.”;
The positions of the head and deputies are classified as political state positions.”;
– in paragraph 22:
in the first paragraph, the word “Director” is replaced with “Head of the National Agency”;
in the eighth paragraph, “deputies of the director” is replaced with “deputies of the head of the National Agency.”
The Cabinet of Ministers of the Kyrgyz Republic must within two months: 1) adapt its decisions in accordance with this decree;
2) take additional measures arising from this decree.
