The status of the National Investment Agency under the President of Kyrgyzstan has been elevated and its role strengthened.

In order to enhance the effectiveness of management in attracting investments, as well as to raise the status of the National Investment Agency under the President of the Kyrgyz Republic, according to Articles 66 and 71 of the Constitution, the decree provides for:

1. The head of the National Investment Agency under the President of the Kyrgyz Republic will participate in meetings of the Cabinet of Ministers on issues related to investment policy, projects, and agreements.

2. Amend the decree of the President of the Kyrgyz Republic "On Approving the Register of State and Municipal Positions of the Kyrgyz Republic" dated January 31, 2017, No. 17. In particular, in the Register of Positions:

in Chapter 1 of Section I:

– change the seventh paragraph to the following text:

“Deputy Chairman of the Cabinet of Ministers, Deputy Head of the Presidential Administration, member of the Cabinet of Ministers (minister, chairman of the state committee), head of the National Investment Agency under the President of the Kyrgyz Republic”;

– change the sixteenth paragraph as follows: “Head of the state body under the President (directly under the President) – except for the head of the National Investment Agency, head of the administrative department under the Cabinet of Ministers and other executive authorities.”

3. Amend the decree of the President of the Kyrgyz Republic "On Issues of the National Investment Agency under the President of the Kyrgyz Republic" dated April 15, 2022, No. 115:

in the Regulation on the National Investment Agency under the President of the Kyrgyz Republic, approved by the said decree:

– change the second paragraph of subparagraph "b" of paragraph 13 to the following:

“carries out centralized coordination of the development, approval, and conclusion of investment agreements, public-private partnership projects, and other investment initiatives, as well as monitoring their implementation;”;

– change paragraphs 17 and 18 as follows:

“17. The activities of the National Agency are managed by its head, who is appointed and dismissed by the President of the Kyrgyz Republic in accordance with the law.

18. The National Agency includes positions of deputy heads, appointed and dismissed by the Chairman of the Cabinet of Ministers upon the recommendation of the head of the agency. Deputies may be appointed from among individuals who are fluent in English or another foreign language.

The deputies report to the head of the agency and act within their authority.”;

– change paragraphs 20 and 21 as follows:

“20. In the absence of the head of the agency, one of the deputies will perform their duties.

21. Employees of the National Agency, except for the head and deputies, as well as employees of the state institution "Center for Public-Private Partnership" and free economic zones, are civil servants.

The positions of the head and deputies of the agency are classified as political state positions.”;

– in paragraph 22:

in the first paragraph, replace the word “Director” with “Head of the National Agency”;

in the eighth paragraph, replace “deputies of the director” with “deputies of the head of the National Agency.”

4. The Cabinet of Ministers of the Kyrgyz Republic within two months:

1) bring its decisions in line with this decree;

2) take necessary measures arising from this decree.
