According to the new Labor Code, which was signed on January 23, non-working public holidays in Kyrgyzstan are established as January 1, 2, 3, 4, 5, and 6 (New Year holidays), as well as January 7 — the day of Orthodox Christmas.
According to the law, working hours before non-working public holidays are reduced by one hour. However, this rule does not apply to those workers who already have a reduced working time established.
Work on public holidays and weekends is prohibited.Engaging workers to work on such days is only possible with their written consent and in the following situations:
- to prevent or eliminate the consequences of accidents, disasters, or natural calamities;
- to prevent accidents, as well as the destruction or damage of property;
- to carry out urgent work without which the normal functioning of the organization or its subdivisions is impossible.
In other cases, work on weekends and public holidays is only possible with the written consent of the employee and the approval of the representative body.Persons with disabilities and pregnant women may be engaged in work on public holidays only if it does not contradict their health condition according to a medical conclusion.
