Member of the Jogorku Kenesh spoke out against 'localized licenses' for lawyers

It is planned to issue licenses to those who have not passed the qualifying exam



A draft law from the Ministry of Justice has been presented to the Jogorku Kenesh, which proposes the introduction of the term "localized license." This license will be issued to individuals who were unable to score the required number of points on the qualifying exam to obtain lawyer status. It is expected that such lawyers will be able to work in areas where there are no professional lawyers.


Deputy Minister of Justice Orozbek Sydykov noted that there are no lawyers at all in the Chon-Alai, Nookat, Jumgal, and Ak-Tal districts, and in the Aravan district, where a significant number of people live, there is only one lawyer functioning. In such situations, people have to seek help from specialists from neighboring districts, which creates an additional burden on the country’s budget, as the law guarantees free legal assistance, and the services of lawyers are paid from the state budget.


Deputy Kubanychbek Samakov opposed this initiative, pointing to the potential risks to the quality of protection of citizens' rights. He believes that "localized licenses" could worsen the situation.


"In these areas, professional prosecutors work, and you want to pit them against lawyers who could not pass the qualifying exam. How can they handle cases on equal terms? Your proposal looks like those who passed the driving test can drive in Bishkek, while those who did not pass can only drive in the villages," the deputy commented.
