According to the initiator, the Constitution and the Civil Code guarantee every citizen the right to dispose of their property, including the ability to bequeath it to individuals who are not close relatives.
However, the deputy notes that in real practice there are legislative gaps that prevent citizens from exercising their legal rights to inheritance, as they are not close relatives of the testator.Among the identified issues are cases where a citizen cannot obtain a death certificate of the testator from a notary to open an inheritance case, as government authorities refuse to issue it, citing the law "On Civil Status Acts." This occurs solely because the individual is not a close relative.
Thus, this situation infringes on the rights of both heirs who are not closely related to the testator and the testator themselves, who wishes to leave their property to those they trust.
To address this issue, the draft law proposes to add a provision to Article 9 of the Law "On Civil Status Acts" that would allow individuals presenting a notarized will to obtain a copy of the death certificate.
