According to the case materials, in June of last year, Bektur, having taken a job as a shepherd for Shabdan, assured the victim that he would take his sheep to pasture in Suusamyr and return them at the end of August. Instead, he took the animals away and handed them over to another shepherd for grazing.
At the end of August 2024, Bektur returned, took the sheep, and sold them in Kara-Balta. He embezzled the 360,000 soms he received and used them for his own purposes while hiding from Shabdan.
- The First May District Court found Bektur guilty of fraud under paragraph 1 of part 2 of article 209 of the Criminal Code of the Kyrgyz Republic, sentencing him to two years of imprisonment in a general regime correctional colony. The court also ordered him to compensate the victim for material damages amounting to 460,820 soms.
- The judicial panel on criminal cases of the Bishkek City Court modified the sentence, increasing the compensation amount to 705,000 soms in favor of the victim, while leaving the other parts of the sentence unchanged.
During the court proceedings, it was revealed that Shabdan's livestock was not registered in the animal identification and tracking system. Moreover, according to data from the Kyrgyz Public Association of Sheep Breeders, Shabdan was not a member of the association and did not register his livestock as the Karakul breed.
The Supreme Court of Kyrgyzstan upheld the decision of the Bishkek City Court, rejecting the cassation appeal of the victim's representative.
