Activists in Bishkek Challenge Restrictions on Rallies

In Kyrgyzstan, discussions continue regarding the provisions of the Law "On Peaceful Assemblies," which, as claimed by civil activists, violate their right to hold rallies without unjustified restrictions.

On December 23, 2025, Tolekan Ismailova and Bermet Borubaeva submitted a petition to the Constitutional Court to declare certain provisions of part 2 of Article 14 and part 2 of Article 15 unconstitutional. These provisions allow local authorities to impose restrictions on the location, time, and route of peaceful assemblies, which effectively leads to prolonged bans in certain areas.

The activists note that such practices contradict Article 39 of the Constitution and Kyrgyzstan's international obligations, including Article 21 of the International Covenant on Civil and Political Rights.

On January 26, 2026, the Constitutional Court rejected the appeal, citing non-compliance with formal requirements, without specifying which particular norms of the law on the Constitutional Court had been violated. This was perceived by the activists as an obstacle to access to constitutional justice.

On February 2, they filed a complaint against the rejection, requesting a reconsideration of the case and the opportunity for the applicants to participate in the process.

It is worth noting that in January 2026, the Pervomaisky Court extended the ban on rallies in the center of Bishkek until March 31, 2025. In the capital, there remains only one place where protests are allowed — the Maxim Gorky Park.
