Minister of Justice on Frequent Amendments: Even the Ministries Themselves Can't Keep Up with the Changes

At the meeting of the committee on judicial and legal issues of the Jogorku Kenesh, Minister of Justice Ayaz Bayetov expressed the opinion that the frequency of changes in the codes is so high that the ministries cannot keep up with these amendments.

On January 20, the committee reviewed a draft law proposing to limit amendments to the codes to once a year - which elicited mixed reactions.

Some deputies opposed this proposal, pointing out that such an approach could negatively affect the legislative process and limit the parliament's capabilities.

According to Bayetov, introducing limits on amendments to the codes is a standard practice necessary for creating a stable legislative framework and long-term planning in various areas. He noted that last year, the most changes occurred in the Code of Offenses - a total of 33 times, with half of the changes initiated by deputies and the other half proposed by the cabinet of ministers.

The minister also reminded that in 2024, the Jogorku Kenesh approved a resolution regarding the implementation of mechanisms to ensure the stability of legislation. The document states that if a law is amended more than six times within a year, it is considered unstable.

Deputy Attorney General Umutkan Konkubaeva supported the draft law from the Ministry of Justice, calling it the right decision. She emphasized that the introduction of new articles into the Criminal Code without proper analysis leads to cases not being initiated, as the real situation often differs from the theoretical one. Konkubaeva noted that adding a new article requires years of analysis of the causes of the problem, rather than reacting to emotions and the media.
