Due to a bureaucratic error, a child with a disability was unable to receive the necessary support for eight years
The Ombudsman's Institute restored the rights of a girl living in an orphanage in the Chui region, who had not had access to state disability benefits for eight years.
According to the press service of the ombudsman, this violation was identified in 2025 during monitoring of children's institutions in the Chui region. Institute staff checked the living conditions and rights of orphans, which led to the discovery of cases where some of them were not receiving the benefits they were entitled to.
The girl in question, M.B., born in 2008, has lived in the orphanage with her sister since 2017 after the death of their parents. In 2015, the medical and social expert commission (MSEC) recognized her as disabled, assigned benefits, and recommended inclusive education.
However, after her transfer to the orphanage in 2017, the payments were stopped because the girl did not undergo a re-examination by the MSEC. The administration of the institution and the responsible authorities did not organize a re-examination, which resulted in the absence of payments for eight years.
Ombudsman Jamila Jamambaeva appealed to the General Prosecutor's Office and the Ministry of Labor, Social Protection, and Migration demanding to restore the girl's rights and pay her the funds owed.
As a result of the investigation, the Ministry of Labor took disciplinary action against the employees responsible for the violation and reinstated the benefit payments to the girl from 2017 until May 1, 2026. A total of 518,000 soms will be transferred to her deposit account.
The Ombudsman's Institute emphasized that the responsibility for protecting the rights of children, including orphans, lies with state authorities and local government bodies.
