The Ombudsman's Subordinates Struggled to Get into the Foreigners' Detention Center. Here's What They Saw

Jamila Dzhamanbaeva, the ombudsman of Kyrgyzstan, drew attention to the situation regarding the conditions of detention and the rights of detainees at the Temporary Detention Center for Foreign Citizens and Stateless Persons, located at the former military base Gansi in the Chui region. The press service of the ombudsman’s institute noted that this situation requires immediate attention from government authorities.

The ombudsman emphasized that her institute's staff had been denied access to the center's territory twice, which violates the norms of the Constitutional Law "On the Akikatchy (Ombudsman) of the Kyrgyz Republic." She called on the authorities to ensure access for specialists to fulfill their professional duties.

According to Dzhamanbaeva, the refusal of access contradicts the law, which guarantees unhindered entry for institute staff to places of forced detention and also imposes responsibility for such refusals.

The ombudsman’s institute considers regular refusals of access to be a worrying sign that may indicate the concealment of human rights violations in the center.

On October 28 of last year, institute staff attempted to monitor the rights of detainees, but they were again denied access. An official act was drawn up in response and sent to the General Prosecutor's Office. The military prosecutor's office responded by sending a submission to the authorized body regarding the need to eliminate violations.

As a result, one of the officials was subjected to disciplinary action.

Only on November 3, 2025, was the institute able to conduct monitoring of the center.

As a result of the inspection, serious violations in the conditions of detention and the observance of the rights of foreigners were identified, the press service reports.

At the time of the inspection, there were 160 people in the center. Sanitary conditions leave much to be desired: toilets are closed, and only three bio-toilets are installed in the yard.

"The building of the center consists of two blocks, which lack heating, and air conditioners only work in four rooms; in the others, they are out of order, making the premises cold. The shower cabins in the center's yard were built in a makeshift manner and are temporary structures," the message notes.

It was also found that detained foreigners cook food outside, although there is a designated cook at the center.

This indicates a failure of the institution to fulfill its obligations to provide safe and adequate nutrition.

Detainees also face a lack of access to legal assistance and communication, as their mobile phones have been confiscated, and the use of other means of communication is prohibited. "They cannot contact their lawyers, relatives, and interpreters," emphasizes the ombudsman. This constitutes a violation of Article 61 of the Constitution of the Kyrgyz Republic and Article 13-1 of the Law "On Guaranteed State Legal Assistance," which provides the right to qualified legal assistance to foreign citizens and stateless persons.

As a result of the monitoring, an official appeal was sent to the Cabinet of Ministers of the Kyrgyz Republic with proposals for comprehensive measures to eliminate the identified violations.

In December 2025, the ombudsman received a request from the lawyers of detained foreigners, after which the institute staff again attempted to visit the center.

"However, the institute staff faced new obstacles in meeting with applicants and monitoring the Temporary Detention Center for Foreign Citizens," the message notes. "At the checkpoint, additional permission was required. Due to the repeated obstruction of the activities of the akiykatchy, an act was drawn up, which was again sent to the General Prosecutor's Office."

In this situation, the ombudsman’s institute called on the Ministry of Internal Affairs to take action against officials obstructing the lawful activities of the chief human rights defender and to ensure transparency in the operations of the Temporary Detention Center.
