The Ombudsman of Kyrgyzstan was complained about by a former polygamist official

The Ombudsman of Kyrgyzstan, Jamilya Dzhamanbaeva, received a request for assistance from a citizen, U.H., residing in Bishkek, to hold her common-law husband — former official M.M. — accountable for polygamy.

According to the press service, U.H. reported that on February 16, 2022, she and M.M. entered into a religious marriage, and an official wedding took place on February 22. The woman stated that her husband claimed to have children, but he does not live with her.

A year later, they had a son, but the child was diagnosed with a severe genetic disease at six months of age.

“He said that our disabled child brings shame to his name and changed his surname. M.M. completely abandoned our son and does not help with his treatment. Doctors recommended taking him to specialists abroad. Thanks to the support of relatives, we managed to undergo treatment outside the country,” U.H. is quoted as saying by the Ombudsman’s press service.

Additionally, the woman noted that M.M.'s first wife and her relatives are putting pressure on her, spreading false rumors, and have repeatedly contacted law enforcement with various complaints.

U.H. also reported that her application to the internal affairs authorities was not considered for five months, and only on December 1 did the Oktyabrsky District Department of Internal Affairs initiate a criminal case under Article 176 "Bigamy and Polygamy" of the Criminal Code of the Kyrgyz Republic.

Staff from the Ombudsman’s institution provided the woman with legal and psychological support and will monitor the progress of the investigation and court proceedings.

An official letter was sent to the General Prosecutor's Office requesting information on the status of the case.

Human rights defenders remind that polygamy is a violation of the legislation of Kyrgyzstan and international norms.
According to the law, polygamy is punishable by community service or corrective labor for a term of one to three years, or a fine ranging from 500 to 1000 calculated indicators (50,000 to 100,000 soms).

Jamilya Dzhamanbaeva emphasizes the importance of timely consideration of citizens' appeals by law enforcement agencies and the necessity of thorough and impartial investigation of all cases.

She also highlights that the protection of the rights of women and children requires special attention, and any violations against them must receive adequate legal assessment.

It was previously reported that the former official in question is Mirbek Miyarov, the former authorized representative of the government in the Chuy region.
