The draft states that these changes are necessary for the implementation of the Law "On Narcotic Drugs, Psychotropic Substances, Their Analogues and Precursors," as well as for improving the state control system in the field of trafficking in such substances.
One of the key recommendations of the draft is to expand the list of controlled substances.
The list of Schedule I narcotic drugs, which are subject to restricted circulation and special control, is proposed to include four new substances from the group of synthetic opioids of the nitazene series:
- N-pyrrolidino protonitazene;
- N-pyrrolidino metonitazene;
- N-desethyl-isotonitazene;
- etonitazepipn.
Additionally, the list of Schedule II psychotropic substances, subject to restricted circulation and special control measures, will include:
- hexahydrocannabinol (HHC/ГГК);
- lisdexamfetamine.
The list of Schedule III psychotropic substances, controlled by general measures, is also proposed to include:
- carisoprodol.
It is equally important that the list of analogues of narcotic drugs and psychotropic substances will be supplemented with new compounds, including 4-BMC/brephredone, 4F-PBP, 4F-PHP, and other substances.
The changes also concern the table of substance quantities that are relevant for qualifying offenses under the Criminal Code and the Code of Offenses. The following threshold values are proposed for the new positions:
- nitazenes: 0.1 grams (small size), 0.1–3 grams (large), 3 grams (especially large);
- lisdexamfetamine: 0.1 grams / 0.1–3 grams / 3 grams;
- HHC: 0.2 grams / 0.2–6 grams / 6 grams;
- carisoprodol: 0.05 grams / 0.05–1.5 grams / 1.5 grams.
The note states that as a participant in international conventions on the control of narcotic drugs and psychotropic substances, Kyrgyzstan must update its national lists. It also mentions the decisions of the Commission on Narcotic Drugs and the operation of the early warning mechanism for new drugs and psychoactive substances.
