The new version of the rules was developed in accordance with the laws adopted in 2025 concerning the procedure for detention and the activities of the Ombudsman of the Kyrgyz Republic.
Procedure for Admission and Detention in Temporary Detention Facilities
The admission and detention of individuals suspected of crimes in temporary detention facilities (TDF) is based on a detention order issued in accordance with the Criminal Procedure Code.This order must contain the case number, reasons and grounds for detention, as well as the time, place of detention, and the results of a personal search. The document is signed by the author and the detainee, and a copy of the detainee's passport or other identification document is attached.
The transfer of detainees to other institutions is carried out based on a court decision or relevant orders from the prosecutor and investigator. Transfers to TDF for the purpose of conducting operational search activities are not permitted.
If an individual who is wanted is detained, the following documents must be attached to the detention order:
- a search warrant;
- an international request from law enforcement agencies of other countries.
All documents must be signed by authorized persons and stamped.Individuals for whom documents are improperly executed are not accepted into the TDF.
The detention period begins from the moment the detainee is delivered to the investigator or inquiry body.
Detainees are accepted by the duty officer at the TDF around the clock, who checks the grounds for their placement in the TDF, conducts an interview, and verifies the information against the data in the detention order. Upon the arrival of a group of detainees, they are temporarily placed in specially equipped rooms for personal searches.
Prohibited items are confiscated for safekeeping with the preparation of an act, and confiscated food products are subject to destruction with notification of the prosecutor.
Money and valuables confiscated from detainees are handed over to the financial department of the internal affairs body, and a copy of the receipt is given to the detainee. When detainees are transferred to a pre-trial detention center, these items are sent to the financial department of the detention center.
Confiscated money and valuables may only be transferred to relatives with the permission of the investigator or prosecutor.After the search, the duty officer informs the detainees about the internal regulations of the TDF and places them in cells.
Placement of Detainees in TDF
It is prohibited to place detainees in unsuitable premises. Distribution among cells should take into account personal characteristics and compatibility of detainees. Smokers should be placed separately from non-smokers.Single confinement does not require the prosecutor's consent in the following cases:
- at the written request of the detainee;
- to ensure safety;
- when there are no other possibilities to comply with placement rules.
Negotiations and correspondence between detainees in different cells are prohibited.Correspondence with individuals at liberty is carried out in accordance with the law.
The following rules must be observed during placement:
1. Separate confinement:
- men and women;
- adults and children;
- suspects and defendants in the same case;
- individuals with first-time criminal responsibility and those who have previously served sentences;
- suspects and defendants, as well as convicted individuals.
- individuals accused of serious crimes;
- those sentenced to life imprisonment;
- individuals who have been judges, prosecutors, or law enforcement officers;
- foreign nationals if conditions for separate confinement are available;
- individuals whose health is at risk;
- individuals with infectious diseases.
- offensive behavior;
- disobedience to staff requests;
- violating rules;
- possessing prohibited items;
- participating in gambling;
- minor hooliganism.
Accused individuals in solitary confinement have the right to a 30-minute walk daily.
Material and Living Conditions
Detainees are provided with the following free of charge:- sleeping places;
- bedding;
- dishes for meals.
- soap and laundry detergent;
- toilet paper;
- board games;
- books and newspapers;
- cleaning supplies.
Women with children receive items for child care.The cells are equipped with:
- video surveillance;
- tables;
- sanitary facilities;
- running water;
- hangers;
- shelves for toiletries;
- trash bins.
Drinking water is provided daily as needed.
The sanitary norm of space per person is 3.25 square meters.
Rights and Duties of Detainees
Detainees have the right to:- be familiar with the internal regulations;
- be safe;
- have visits from defenders and relatives;
- keep documents related to their case;
- submit complaints and suggestions;
- correspond;
- receive food and medical care;
- have eight hours of sleep;
- take daily walks;
- use personal belongings;
- have access to literature and board games;
- conduct religious ceremonies;
- receive parcels;
- be treated politely;
- participate in civil transactions.
Detainees are obliged to:
- maintain order;
- uphold hygiene;
- follow fire safety rules;
- maintain a neat appearance;
- keep cells clean;
- comply with staff requests;
- not threaten life and health;
- handle property carefully;
- maintain silence;
- clean their cells.
- having mobile phones;
- disturbing the peace and communicating with other detainees;
- throwing objects;
- refusing to comply with orders;
- closing observation holes;
- damaging property;
- consuming alcohol and drugs;
- keeping money;
- exchanging items;
- violating correspondence rules.
Procedure for Handling Complaints and Applications
The head of the TDF and their deputy conduct daily rounds of the cells to receive suggestions and complaints. Oral requests are recorded in a log and forwarded to the responsible person. Written complaints are registered and sent to the management for consideration.Requests addressed to government authorities are sent through the duty officer of the TDF. Complaints about the actions of the court or investigator are considered in accordance with the Criminal Procedure Code.
Responses to requests are announced to the detainees and attached to their personal files.Persecution for submitting complaints is prohibited. Officials guilty of this may be held accountable.
The costs of sending complaints are covered by the internal affairs body.
Procedure for Correspondence with Relatives
Detainees are allowed to correspond without restrictions. For this purpose, computers with internet access are provided in the TDF.Letters are processed through the TDF's email. The duty officer accepts letters only in unsealed envelopes with the sender's details indicated.
Messages about the death of relatives are conveyed to detainees immediately.Letters received after the departure of the detainee are sent to the address of their departure within three days.
