Kyrgyzstan Prepares Maritime Code: Fleet Under the Flag of Kyrgyzstan and Ship Registry
The Code covers issues related to commercial shipping and asserts Kyrgyzstan's right, as a landlocked state, to access international waters and freedom of navigation in accordance with international law.
The document defines the legal, economic, and organizational aspects of maritime transport, as well as establishes rules for the use of vessels for various purposes.
In particular, this concerns the transportation of passengers and cargo, fishing, exploration of marine resources, scientific research, rescue operations, and yachting.
One of the main aspects of the project is the creation of a state (international) registry of vessels of Kyrgyzstan, which will include data on vessels authorized to sail under the flag of the republic. The owners of such vessels can be both citizens and companies of Kyrgyzstan, as well as foreign citizens.
It is proposed that the port of registration for vessels be the city of Bishkek, and the name BISHKEK should be displayed on the stern of the vessels in Latin letters.
The project also includes the establishment of a maritime administration of the Kyrgyz Republic, which will be responsible for coordinating commercial shipping, maintaining the vessel registry, ensuring navigational safety, and compliance with international standards.
In addition, the Code addresses issues related to vessel registration, issuance of ship documents, arrest of vessels, maritime transport, as well as regulating the activities of crews and the powers of captains.
The document clearly states that military vessels and ships carrying nuclear materials are not subject to registration under the flag of Kyrgyzstan.
