According to the new Labor Code, which was signed on January 23, the non-working public holidays in Kyrgyzstan are January 1, 2, 3, 4, 5, and 6 (the period of New Year holidays), as well as January 7 — Orthodox Christmas.
According to the legislation, the working day (shift) preceding a non-working public holiday is reduced by one hour. However, if a reduced working time has already been established for employees, this reduction does not apply.
Working on public holidays and weekends is strictly prohibited.Employers may engage employees to work on non-working public holidays and weekends only with their written consent in the following situations:
- to prevent or eliminate the consequences of industrial accidents or natural disasters;
- to prevent accidents and damage to property;
- to carry out urgent tasks that affect the further operation of the entire enterprise or its individual divisions.
In other cases, to engage employees to work on weekends, written consent from the employee and approval from the representative body of the labor collective is required.Working on non-working public holidays for people with disabilities and pregnant women is possible only if it does not contradict their health condition, which must be confirmed by a medical certificate.
