Lack of Analysis and Protection of Migrants: What Concerns Experts in Kyrgyzstan

Recent changes to anti-extremist legislation in Kyrgyzstan have contributed to an increase in criminal cases related to citizen activity and religious practices. This statement was made at a seminar dedicated to analyzing the impact of legislation on human rights, particularly concerning women and minorities.

Human rights defenders express particular concern about the systematic impunity of officials who violate the fundamental rights of citizens, as well as the lack of independent expertise in the Kyrgyz language, as emphasized by the organization "Bir-Duino Kyrgyzstan."

Gathered lawyers, human rights defenders, and representatives of the ombudsman institution discussed the growing pressure on vulnerable groups, including women, ethnic minorities, and labor migrants, in the context of tightening legal norms.

Seminar participants noted that the adoption of Russian legal models, including laws on "foreign agents" and media, has led to an increase in criminal cases for statements and civic activity.

Particular concern is raised by the absence of independent linguistic expertise in the country, which violates the principles of fair trial.

During the discussion, Alexander Verkhovsky, head of the "Sova" research center, proposed implementing a "six-part test" for evaluating statements in judicial practice. This method includes analyzing the context, the author's personality, intent, and potential consequences, which could help avoid prosecution in the absence of a real threat. According to experts, courts currently often base their decisions solely on the content of materials, without considering the motives of the accused.

Discussing the role of education, Jamal Frontbek kyzy, head of the "Mutakallim" association, emphasized that a low level of education increases the likelihood of radicalization, especially among women. She proposed opening a women's department in the Spiritual Administration of Muslims of Kyrgyzstan for early prevention of extremism.

Human rights defender Tolekan Ismailova noted that preventive measures against radicalization should be based on education and critical thinking, rather than criminal prosecution. She is convinced that only maintaining a balance between security and human rights can ensure sustainable development of society.

Experts also noted that Kyrgyzstan improved its position in the Global Terrorism Index by five points for 2025, which raises questions about the necessity of further tightening legislation.

Recommendations: from monitoring court processes to reforming the DUMK


Based on the discussion, experts developed a series of specific recommendations for government bodies and the ombudsman institution.

Seminar participants expressed confidence that adherence to the Constitution will be an important step toward Kyrgyzstan obtaining a seat on the UN Security Council in the near future.

Previously, the Cabinet of Ministers proposed a series of amendments to legislation aimed at enhancing national security. However, international organizations such as the UN and OSCE have repeatedly urged Kyrgyz authorities to maintain balance and avoid vague interpretations of the terms "extremism" and "incitement to hatred," which could be used to restrict freedom of speech.
