Linear facilities are structures whose length significantly exceeds their width, intended for the transmission of resources, energy, or transportation, such as roads, pipelines, and power lines.
These include highways, railway tracks, power lines, pipelines, and communication lines.
According to the developers, the main goal of the new order is to legally regulate the mechanism for combining design and construction, which will allow for a reduction in the implementation time of infrastructure and investment projects, as well as establish clear and transparent rules for interaction between customers, design and construction organizations, and government authorities.
This document establishes a unified procedure for obtaining permission for the combination of design and construction of linear facilities, as well as regulates the duties, timelines, powers, and responsibilities of all participants in the process.
The proposed scheme will allow the customer to start construction and installation work immediately after obtaining permission for the combination, while ensuring the simultaneous receipt of the necessary permit documents, such as urban planning conclusions and engineering and technical conditions.
All responsibility for compliance with technical regulations and normative documents in the field of urban planning and architecture will be placed on the customer, the general contractor, subcontracting organizations, technical supervision, as well as the chief architect and chief engineer of the project.
All participants must guarantee the execution of work in strict accordance with safety and quality requirements.
The customer is obliged to obtain all necessary permit documents within 45 days. After obtaining them, the facility will be included in the register of construction projects. The Ministry of Construction may extend the deadline once upon a justified request from the customer.
If the customer fails to meet the specified deadlines, the validity of the combination permit will be suspended for one month to eliminate the identified discrepancies.
After this period, if the requirements are not met, the permit will be revoked. Additionally, if violations of technical regulations or the conditions for issuing the permit are discovered, the validity of the permit will be suspended until the violations are rectified.
At the same time, the customer has the right to appeal decisions regarding the suspension or revocation of the permit in accordance with the law of the Kyrgyz Republic "On the Basics of Administrative Activity and Administrative Procedures".
