The Parliament of Kyrgyzstan has adopted a bill amending the law on public procurement.

At the meeting of the Jogorku Kenesh, the deputies reviewed and adopted the draft law "On Amendments to the Law of the Kyrgyz Republic on State Procurement" in three readings.

The initiator of the draft law is the Chairman of the Cabinet of Ministers.

The information about the draft law was presented by the Minister of Economy and Commerce, Bakyt Sydykov.

According to him, the norms proposed by the draft law are aimed at optimizing and simplifying the processes of state procurement. The draft law also introduces the concept of a state assignment in the field of state procurement in the context of fulfilling important and strategic tasks of the state. Improving the legal regulation in the field of state procurement will contribute to the sustainable development of the state and strengthen its institutional system.

According to the document, conducting competitions and transparent procedures will become optional. Legal entities with state participation will be appointed as executors of state assignments. At the same time, the draft law contains a provision allowing the general contractor to transfer up to 50% of the received budget funds to subcontracting organizations, which effectively removes a significant portion of the money from direct competitive control.

A special procedure is also provided for ensuring the activities of the Presidential Administration and conducting official events with the participation of the head of state, the speaker, the chairman of the cabinet, and foreign delegations.

During the discussion, Deputy Suyunbek Omurzakov clarified questions regarding Article 2, paragraph 5 of the law on state procurement, which states that amendments to this law can be made no more than once a year.

Deputy Dastan Bekeshev raised questions in the area of determining subcontractors, expressing concern about corruption risks during their selection and the interaction between state enterprises and private companies.

Deputy Kunduzbek Suimanov supported the proposed norms and emphasized that the draft law is aimed at the effective and rational use of funds from the republican and local budgets in state procurement.

Deputy Mederbek Aliyev emphasized that the norms proposed by the draft law meet the requirements of the times, adding that when conducting a tender, the purchasing organization is forced to pay attention to the low cost, which in such circumstances reduces the quality of the purchased goods, works, and services.
