The Cabinet approved the procedure for maintaining state registers of breeding achievements and traditional knowledge.
This document was adopted to implement the laws "On Legal Protection of Breeding Achievements" and "On Protection of Traditional Knowledge," and it defines the procedures for registering objects that are granted legal protection, as well as recording all changes to their legal status, including the transfer of rights and licenses, as well as their suspension and restoration.
Furthermore, the resolution cancels a number of previous government decisions regarding the maintenance of state registers of intellectual property objects, including the main resolution No. 155 dated February 29, 2012, and its amendments. This action aligns the accounting system for breeding achievements and traditional knowledge with updated legislation.
The resolution will come into effect ten days after its official publication in the newspaper "Erkin Too".

PROCEDURE
for maintaining the State Register of Protected Breeding Achievements of the Kyrgyz Republic
Chapter 1. Registration of Breeding Achievements in the State Register of Breeding Achievements
1. The State Register of Protected Breeding Achievements of the Kyrgyz Republic (hereinafter referred to as the State Register of Breeding Achievements) is an official document intended for the registration of breeding achievements for which patents of the Kyrgyz Republic have been issued, as well as for making changes to their legal status.
2. The State Register of Breeding Achievements is a book with page numbering, bound and certified with a seal, which is kept in the Ministry of Science, Higher Education, and Innovations of the Kyrgyz Republic (the authorized body).
3. The State Electronic Register of Breeding Achievements is a publicly accessible database for registering protected breeding achievements and all changes to their legal status.
4. Upon the applicant's request, an electronic protection document (patent for the breeding achievement) is issued.
5. To enter information about a breeding achievement in the State Register of Breeding Achievements, a registration decision and payment of the established fee for registration, publication, and issuance of the patent are required.
6. The following data is entered into the State Register of Breeding Achievements:
1) registration number (patent);
2) date of registration;
3) application registration number;
4) date of application submission;
5) application number for conventional priority;
6) date of conventional priority;
7) country of conventional priority (country code);
8) date of publication of information about the breeding achievement, bulletin number;
9) name of the breeding achievement;
10) surname, first name, patronymic or full name of the applicant(s), country code;
11) surname, first name, patronymic of the author(s), country code;
12) surname, first name, patronymic or full name of the patent holder(s), country code;
13) surname, first name, patronymic and registration number of the patent attorney;
14) address for correspondence.
7. Within a month after receiving the decision, the authorized body:
1) enters data about the breeding achievement into the State Register of Breeding Achievements;
2) publishes information about the registered breeding achievement in a specified volume;
3) issues a patent for the breeding achievement.
Chapter 2. Making Changes and Additions to the State Register of Breeding Achievements
8. During the maintenance of the State Register of Breeding Achievements, the following changes may be made:
1) change of the name or surname, first name, patronymic of the patent holder and/or address;
2) information about the assignment contract for the patent;
3) data about the licensing agreement for the use of the breeding achievement;
4) recognition of the registration of the breeding achievement as invalid;
5) termination of the patent;
6) correction of obvious and technical errors;
7) issuance of a duplicate patent;
8) restoration of the patent's validity;
9) information about a compulsory license;
10) information about an open license;
11) transfer of rights during reorganization;
12) transfer of rights by inheritance.
9. The State Register of Breeding Achievements includes information about the change of name or surname, first name, patronymic of the patent holder and/or address of their location.
10. The basis for making changes is a request from the patent holder, patent attorney, or authorized representative with formalized powers.
11. The application is submitted in the state or official language, signed by the patent holder, patent attorney, or representative. For legal entities, the application is signed by the head or authorized person with the indication of full name, position, and seal.
12. The application may be submitted in person, by mail, or by email to the authorized body.
13. The application must contain the following data:
1) patent number;
2) date of registration;
3) application number;
4) date of application submission;
5) name of the breeding achievement;
6) old and new surname, first name, patronymic or name and address of the patent holder.
14. The following documents are attached to the application:
1) a copy of the document confirming the legitimacy of the changes;
2) a document on the payment of the fee;
3) a power of attorney if the application is submitted through a representative.
15. Foreign legal entities must provide a document on the legitimacy of the changes in accordance with the legislation of their country.
16. During the review process, a request may be sent for the submission of missing or clarifying materials within two months.
17. The authorized body, upon compliance of the documents, within a month:
1) makes changes to the State Register of Breeding Achievements;
2) publishes information about the changes made;
3) issues an additional sheet to the patent.
18. If the necessary documents are not submitted on time, the changes are not made.
19. The State Register of Breeding Achievements includes information about contracts for the assignment of patents or licensing agreements.
20. The basis for making entries is the decision of the authorized body and the document on the payment of the fee.
21. Within a month after receiving the decision, data is entered about:
1) successors under the assignment contract;
2) licensees under the licensing agreement.
22. An additional sheet to the patent is issued or sent to the address of the patent holder.
23. The State Register of Breeding Achievements includes information about the recognition of the patent as invalid.
24. The basis is the decision of the Appeal Council or the court.
25. Data on the invalidity of the patent is entered if, at the date of issuance, it did not meet the novelty conditions or if the specified holder did not have the rights to obtain the patent.
26. The authorized body enters the relevant information and publishes information about the invalidity of the patent within a month.
27. The State Register of Breeding Achievements includes data on the termination of the patent's validity.
28. The basis for termination is the order of the authorized body.
29. Data is entered on termination upon expiration of the term established by law.
30. Data is entered on the early termination of the patent in the following cases:
1) non-payment of the fee;
2) failure to provide materials for checking the protectability;
3) non-compliance with the conditions of homogeneity and stability.
31. The authorized body enters data on the termination of the patent's validity and publishes the corresponding information within a month.
32. The State Register of Breeding Achievements includes information about the correction of obvious and technical errors upon the request of the patent holder.
33. The application must contain data about the errors being corrected.
34. The application is submitted in the state or official language, signed by the holder or their representative.
35. The application can be submitted in person, by mail, or by email.
36. The authorized body within a month:
1) enters information into the State Register of Breeding Achievements;
2) publishes information about the corrections.
37. The State Register of Breeding Achievements includes information about the issuance of duplicates of patents or author certificates.
38. The basis is the application of the patent holder or their representative.
39. The application is submitted in the state or official language and signed by the relevant persons.
40. If there are multiple holders, the duplicate is issued upon a joint application.
41. The application can be submitted directly, by mail, or by email.
42. The following documents are attached to the application:
1) document on the payment of the fee;
2) power of attorney if the application is submitted through a representative.
43. The authorized body within a month:
1) enters information about the issuance of the duplicate in the State Register of Breeding Achievements;
2) publishes information about the issued duplicates;
3) issues the duplicate to the holder or their representative;
4) issues the author certificate.
44. The duplicate patent has legal force equivalent to the original.
45. The duplicate is issued on the appropriate form marked "Duplicate".
46. The duplicate of the author certificate is also issued with the mark "Duplicate".
47. The patent loses its legal force upon the issuance of a duplicate.
48. The State Register of Breeding Achievements includes information about the restoration of the patent's validity.
49. According to the law, the validity may be restored upon the petition of the patent holder.
50. The petition is submitted within three years for plant varieties and five years for other categories.
51. The petition must be signed by the patent holder or their representative.
52. The petition can be submitted directly, by mail, or by email.
53. The petition must contain:
1) patent number;
2) date of registration;
3) application number;
4) date of application submission;
5) name of the breeding achievement;
6) surname, first name, patronymic, and address of the patent holder.
54. Documents on the payment of fees are attached to the petition.
55. The petition is reviewed within ten working days.
56. In the absence of necessary documents, a request is sent for their provision.
57. The term of the patent is restored upon compliance with the conditions for submitting the petition.
58. The authorized body within a month:
1) enters information about the restoration in the State Register of Breeding Achievements;
2) publishes information about the restoration;
3) notifies the holder about the restoration of the patent's validity.
59. If documents are not submitted on time, restoration is not carried out.
60. The State Register of Breeding Achievements includes information about the granting of a compulsory license.
61. The basis is a court decision or permission from the Cabinet of Ministers.
62. A fee is charged for entering information about the issuance of a compulsory license.
63. The State Register of Breeding Achievements includes information about the granting of an open license and its termination.
64. The basis is the application of the patent holder or their representative.
65. The application is submitted in the state or official language and signed by the relevant persons.
66. The application can be submitted directly, by mail, or by email.
67. The application for granting an open license must contain:
1) patent number, date of registration;
2) application number, date of submission;
3) name of the breeding achievement;
4) data of the patent holder;
5) contact information;
6) amount of payments.
68. The application must contain a condition regarding the right to use the breeding achievement upon payment of fees.
69. Documents on the payment of the fee are attached to the application.
70. The application for the termination of an open license must contain:
1) patent number, date of registration;
2) name of the breeding achievement;
3) data of the patent holder.
71. The authorized body publishes information about licenses within a month.
72. The State Register of Breeding Achievements includes information about the transfer of rights during reorganization.
73. The basis is the application of the patent holder or their representative.
74. The application is submitted in the state or official language and signed by the relevant persons.
75. The application can be submitted directly, by mail, or by email.
76. The application must contain data about:
1) patent number;
2) date of registration;
3) name of the breeding achievement;
4) data of the holder and successor.
77. Documents on the payment of the fee are attached to the application.
78. The authorized body within ten days:
1) enters data into the State Register;
2) publishes information about the transfer of rights;
3) issues an additional sheet about the transfer of rights.
79. The State Register of Breeding Achievements includes data on the transfer of the patent and rights to obtain the patent by inheritance.
80. The basis is the application of the heir.
81. The application is submitted in the state or official language and signed by the heir or their representative.
82. The application can be submitted directly, by mail, or by email.
83. The application must contain data about:
1) patent number;
2) date of registration;
3) name of the breeding achievement;
4) data of the holder and heir.
84. A copy of the inheritance certificate and a document on the payment of the fee are attached to the application.
85. During the review process, a request may be sent for the submission of missing materials.
86. The authorized body within a month:
1) enters data about the inheritance in the State Register of Breeding Achievements;
2) publishes information about the transfer of rights;
3) issues an additional sheet to the patent.
87. If documents are not submitted on time, changes are not made.
88. An extract from the State Register of Breeding Achievements is issued upon the request of the holder or their representative.
89. The request is submitted in the state or official language and signed by the relevant persons.
90. The request must specify:
1) patent number;
2) date of registration;
3) name of the breeding achievement;
4) data of the patent holder.
91. The request is reviewed within ten working days.
92. An extract from the State Register of Breeding Achievements is issued within the established time frame.
