Who will defend doctors and medical professionals from professional risks?
According to him, all medical workers in Kyrgyzstan need the implementation of health insurance and legal protection from criminal prosecution in case of professional risk.
Abdieyev also noted: “Specialists of such a level as Nasira Beishebayeva are very rare, as training a transplant surgeon requires many years of education!”
By keeping her in custody, law enforcement agencies risk depriving other children of life while the case is under investigation.
Although after public outcry and protests from colleagues Beishebayeva was placed under house arrest, the very fact that a doctor who has saved many lives was arrested is perplexing.
How could this happen? The answer lies in the fact that our law enforcement system predominately adopts a punitive approach instead of a professional and measured approach to each case.
Why is this so wrong?
Even for someone like me, who is far removed from medicine, it is clear: there is a fundamental difference in medicine between negligence and an unfavorable outcome. An unfavorable outcome is a tragedy, where even with perfect adherence to all protocols, a patient may not survive.
Unfortunately, investigative bodies often do not distinguish between these concepts, viewing any death in a hospital as a criminal act. It is important that medical experts understand such nuances, not investigators.
Arrest and detention are only permissible for those who pose a danger to society. But what threat could an experienced doctor pose? Isolation will not restore a patient’s health, but it can destroy the reputation and life of a doctor.
Those making such decisions must understand the demoralizing effect they have on the entire medical field!
After such cases, young specialists may refuse to take on complex cases. Why take responsibility for a complicated patient if prison awaits for any risk?
Thus, we risk being left without high-class specialists.
You cannot evaluate decades of impeccable work based on one unfortunate case before a final court decision and independent expertise.
And the main question is: where is the health insurance? In developed countries, medical errors are resolved within the framework of liability insurance. The insurance company pays compensation to the family, while a medical commission assesses the qualifications of the doctor.
We need to implement health insurance and ensure legal protection for doctors from criminal prosecution for professional risks.
Otherwise, tomorrow our children may find themselves in the hands of healers and charlatans,” he concluded.
