Do you remember the story of Murat Cherikbaev? The authorities announced the need to demolish his house, which is the only one on this street, citing its proximity to an inactive heating pipeline. As a result of the stress, the man was diagnosed with cancer.

Now the situation has escalated: despite the fact that Cherikbaev has already dismantled part of his house, local authorities are demanding complete demolition. At the same time, neighboring houses, whose owners cannot provide property documents, remain untouched.

The Cherikbaev family is asking: "Why are double standards applied to us?"

The family has appealed to the prosecutor's office to assess the legality of the authorities' actions.

Zarina Beyshembaeva, Murat's daughter, reported that their family purchased the house in 1987, but according to her, the building was erected back in 1957.

Problems began in 2019 when a neighbor filed a complaint with the Land Use Control Department, claiming that the house was built illegally. As a result, the department went to court. The man did not have property documents, which, according to Beyshembaeva, were issued selectively.

She noted: "In our area, there is a selective approach to issuing documents. Why is the demolition case being revived against us when there are many other houses on the street without documents? I am appealing to the Attorney General to investigate whether there was any corruption in this process?"

Lawyer's Opinion

Lawyer Indira Sautova, representing the family's interests, explained that the inspecting authorities refer to a violation of the protection zone, as a heating pipeline runs through the alley.

She added: "These houses were built in 1957-1958, and the pipeline was laid only in 1978, that is, after their construction. According to the documents, the protection zone is 25 meters, but we see that the houses are within this zone, and some have property documents. Why are such measures being applied to Cherikbaev?"

Sautova noted that there are houses in the alley that are very close to the pipeline.




Sautova also stated: "We have repeatedly appealed to the prosecutor's office of the October district, pointing out the existence of property documents for some neighbors, while others lack them. How could the authorities issue construction permits if the protection zone is not being observed?"

The lawyer highlighted the biased attitude towards Cherikbaev, noting that part of his house was dismantled in accordance with a court decision.


She concluded: "Right now, the focus is solely on the demolition of Cherikbaev's house, while the problem affects the entire district. A comprehensive investigation is needed, starting with the issuance of property documents. We suspect that those who had the means were able to obtain them, while those who acted legally risk being left without a roof over their heads."

He said: "How can it be that one person is issued documents while another is not? This creates serious problems. Some neighbors with documents are pressuring those who cannot obtain them, filing lawsuits and demanding the demolition of their houses. This is extremely unfair."
