The main goal of the amendments is to improve the efficiency and rationality of budget expenditures when acquiring certain goods, works, and services.
According to the new provisions, procurements related to the organization of international events of state level will no longer be subject to the law on public procurement. This applies to events involving high-ranking officials such as the President of the Kyrgyz Republic, the Speaker of the Jogorku Kenesh, and the Prime Minister, as well as visits from foreign states, governments, and international delegations.
These procurements will be made based on civil law agreements between the customer and the contractor in accordance with the civil legislation of the Kyrgyz Republic.Additionally, the law introduces a new definition - "state assignment," which implies financing legal entities with state participation to accomplish priority tasks that contribute to the socio-economic development and cultural progress of the country.
Procurements related to state assignments will also not be subject to regulation under the law on public procurement and will be formalized through civil law contracts between state customers and contractors, with mandatory specification of performance indicators.
The law also implies personal responsibility for both the state customer and the contractor for the targeted and effective use of budget funds.
The changes are targeted and aimed at quickly resolving procurement issues in certain sectors financed from the republican and local budgets.
