What is the purpose of the EAEU Court?

The court's task is to ensure the uniform application of the Treaty on the Eurasian Economic Union and other international agreements among its members.

The court consists of two judges from each EAEU member state.

What is the focus of Kyrgyzstan's lawsuit?

Azmat Mukhanov, head of the Mandatory Health Insurance Fund of Kyrgyzstan, stated at a parliamentary meeting that the Russian side is violating the terms of the EAEU agreements, according to which compulsory health insurance must also be provided to the family members of those working in Russia.

Later, the fund clarified that the appeal to the court was initiated by the Cabinet of Ministers and submitted by the Judicial Representation Center under the Ministry of Justice of Kyrgyzstan.

The lawsuit concerns the clarification of paragraphs 3 and 4 of Article 98 of the EAEU Treaty, which relate to access to social security, including compulsory health insurance for the family members of workers from EAEU member states.

The fund emphasized that this issue is regularly raised by the Kyrgyz side on various platforms and within the framework of intergovernmental commissions. The appeal to the EAEU Court is part of the discussion within the integration process.

What do the specified paragraphs of the treaty regulate?

Since January 1, 2017, workers from EAEU countries have had access to health insurance in Russia.

Article 98. Rights and obligations of workers of the member state
Annex states that emergency medical assistance (in emergency and urgent cases) is provided to workers and their family members free of charge, regardless of the presence of a medical policy. However, for further treatment in a medical institution after the immediate threat to the life or health of the patient has been eliminated, services are paid at established rates.

The conditions for obtaining a medical policy for foreign citizens have also changed. According to the information and legal portal "Garant," to receive free medical assistance, migrants must legally work in Russia for at least five years.
