However, the current system has effectively equated military ranks with civil ranks, which is incorrect, as they should remain distinct, preserving the superiority of military service.
The GKNB believes that granting military ranks to civilian prosecutors is inappropriate and unjustified. This blurs the lines between military and civil service, undermining the authority of military service.According to the proposed draft, the procedure for appointing prosecutors to civil ranks and military ranks will be determined by the Attorney General.
The proposed civil ranks and titles for prosecutors include:
- Attorney General - State Justice Advisor of the 1st class (instead of Justice Colonel General);
- First Deputy Attorney General - State Justice Advisor of the 2nd class (instead of Justice Lieutenant General);
- Deputy Attorneys General and prosecutors of regions (Batken, Jalal-Abad, Osh, and Chui regions, as well as the prosecutor of Bishkek) - State Justice Advisor of the 3rd class (instead of Justice Major General);
- Deputy Attorney General - Military Prosecutor - Justice Major General (remains unchanged under current legislation);
- Prosecutors of regions and specialized prosecutors, heads of structural divisions of the General Prosecutor's Office and their deputies - Justice Advisor of the 1st class (Justice Colonel);
- Heads of structural divisions of prosecutors' offices and senior prosecutors - Justice Advisor of the 2nd class (Justice Lieutenant Colonel);
- Senior assistants and investigators of the military prosecutor's office - Justice Lieutenant Colonel (remains unchanged);
- Prosecutors of cities and districts - Justice Advisor of the 3rd class (Justice Major);
- Prosecutor assistants - Justice Lawyers of the 1st, 2nd, and 3rd classes (Justice Captain, Senior Lieutenant, Lieutenant, and Junior Lieutenant);
- Assistants to the garrison military prosecutor - Captain, Senior Lieutenant, Lieutenant, and Junior Lieutenant of Justice (unchanged).
The draft also establishes terms for holding civil ranks:
- Junior Lawyer - 1 year;
- Justice Lawyer of the 3rd class - 2 years;
- Justice Lawyer of the 2nd class - 3 years;
- Justice Lawyer of the 1st class - 4 years;
- Justice Advisor of the 3rd class - 5 years;
- Justice Advisor of the 2nd class - 6 years.
There are no limits for the Justice Advisor of the 1st class.
The highest civil rank, "State Justice Advisor of the 3rd class," may be granted to the Attorney General no earlier than six months, while for other positions - no earlier than two years from the date of appointment.
Individuals holding the rank of "Justice Advisor of the 1st class" and who have previously held high state positions may count the time spent in those positions towards the terms for obtaining the highest special class.
The granting of civil ranks of State Justice Advisors of the 3rd, 2nd, and 1st classes, as well as the military rank of Justice Major General, is carried out by the President of the country.
The Attorney General is responsible for granting other civil ranks and titles, including Junior Lawyer and military ranks such as Junior Lieutenant, Lieutenant, and Captain.It is important to note that the granting of ranks and titles must occur strictly in the established sequence.
In case of improper performance of official duties, prosecutors may be demoted in civil rank or military rank by one step.
